ORDER This writ petition has been filed seeking for a direction to the respondents 1 to 5 to take all steps that are necessary to ensure that the undertaking given by the respondents 6 to 8 in the peace committee meeting held on 19.01.2025 is effectively implemented in letter and spirit and consequently to remove the stone pillar erected by the respondents 6 to 8 within the precincts of the Ayyanar Temple forthwith by considering the representation dated 10.03.2026 of the petitioner. 2/6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.2051 of 2026 2. The learned counsel appearing for the petitioner submitted that the petitioner is a senior citizen and a native of Mangudi Village, where a temple, namely the Ayyanar Temple, is situated on the land comprised in Survey No. 274, on the banks of the Kidapuri lake bund. The said temple belongs to the villagers of Mangudi and Kidapuri, and its management is vested with the elders of both villages. Around 250 families participate in the festivals of the said temple. The petitioner, along with other villagers, has been taking care of the administration of the temple for several years. The temple festival, namely ‘Puravi Yeduppu’, has been conducted every year since 1972. A committee consisting of members from both villages is elected from among the villagers, and the temple festival is conducted peacefully from time to time. Other villagers are also permitted to participate in the festivals. Three-fourths of the organizers, namely Ayakattudharars, are from both villages. The subject property is classified in the revenue records as ‘Kidapuri Kanmoi’. 3. The learned counsel appearing for the petitioner further submitted that with respect to the installation of the Ayyanar idol in the said temple, a dispute arose at the instance of the private respondents herein, who belong to Kidapuri Village, against the will of the villagers of both villages. In connection with the said dispute, a peace committee meeting was conducted by the third respondent on 19.01.2025. In the said meeting, on behalf of Mangudi Village, the following persons, namely, Vairamuthu, N. Lakshmanan, V. Chinnasamy, K. Ramanathan, and A. Nellaiappan, participated as ‘A’ party, and on behalf of Kidapuri Village, A. Aiyappan, K. Pandian, Selvakumar, S. Palani Murugan, and Muniyandi participated as ‘B’ party. In the said peace committee meeting, it was specifically recorded that no person from either of the two villages shall independently install or erect a stone pillar in the said temple. On 17.02.2026, the petitioner lodged a complaint with the second respondent police, and CSR No. 0076 of 2026 was issued. However, no action has been taken. Hence, this petition has been filed. 4. The learned Government Advocate Mr.M.Sakthi Kumar, appearing for the respondent police submitted that on receiving the complaint from the petitioner, the respondent police promptly issued CSR to the petitioner and thereafter, the matter was informed to the third respondent Tahsildar and now, it is for the third respondent to look into the same. 4/6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.2051 of 2026 5. The learned Government Advocate Mr.C.Satheesh, appearing for the other official respondents submitted that the matter is pending before the third respondent and the third respondent will look into the same. 6. Heard the learned counsel on either side and carefully perused the materials placed before this Court. Since no adverse order is proposed to be passed against the private respondents, notice to them is dispensed with. 7. Considering the facts and circumstances of the case, the third respondent is directed to forthwith look into the matter and conduct a discreet enquiry to ascertain whether the decision arrived at between the parties pursuant to the peace committee meeting held on 19.01.2025 has been flouted. If such violation is found, the third respondent is directed to take necessary action against the violators and also to take an appropriate decision with respect to the newly installed stone pillar, within a period of eight weeks from the date of receipt of a copy of this order. 8.
