This writ petition under Articles 226 and 227 of the Constitution of India, 1950 has been filed by the petitioner praying for quashing the impugned order dated 12.12.2025 passed in G.I.A. Case No.513/2011 by the State Education Tribunal, Odisha. In the said impugned order dated 12.12.2025 passed in G.I.A. Case No.513/2011, when the State Education Tribunal, Odisha refused to call for the records sought for by the petitioner assigning the reasons that, “when the Hon’ble High Court directed to dispose of the said G.I.A. Case No.513/2011 within the stipulated time i.e. by the end of 2025 on the basis of the materials available in the record as well as on the report of the D.E.O i.e. who was actually appointed and who continued in the school and discharge the duties as a classical teacher, then, the question of calling for the documents as required by the petitioner in G.I.A. Case No.513/2011 is not required”. To which, the petitioner in G.I.A. Case No.513/2011 challenged by filing this Writ Petition praying for quashing the WP(C) No.2050 of 2026 said impugned order dated 12.12.2025 passed in G.I.A. Case No.513/2011 by the State Education Tribunal, Odisha on the ground that, the documents those were called for by the petitioner are required for the proper adjudication of the G.I.A. Case No.513/2011 or else, the petitioner shall be prejudiced, for which, the impugned order is liable to be quashed and the documents are to be called for. 2. Heard from the learned counsel for the petitioner, the learned counsel for the Opp. Party No.5, the learned counsel Ms. Sruti Lekha Dhal for the Opp. Party No.4 and the learned Addl. Standing Counsel for the State. 3. During the course of hearing, the learned counsels of both the sides fairly submitted that, the documents, those were sought to be called for by the petitioner, the said documents have been filed by the petitioner in this writ petition and the Government has already submitted its counter affidavit on 04.11.2025 in this Writ Petition stating about the appointment and continuance of the classical teacher. 4. When, the documents, those were required to be called for by the petitioner to the G.I.A. Case No.513/2011, the said WP(C) No.2050 of 2026 documents are in the records of this writ petition on being filed by the petitioner and indicating about the same in detail about the required queries of the petitioner in the counter affidavit of the State, then, at this juncture, on the basis of the aforesaid submissions of the learned counsels of both the sides as well as on the basis of the documents filed by the petitioner and the counter submitted by the State, it is felt proper to dispose of this writ petition finally without interfering with the impugned order dated 12.12.2025 passed in G.I.A. Case No.513/2011 by the State Education Tribunal, Odisha directing the petitioner to submit the copy of the counter affidavit of the State filed in this Writ Petition as well as the documents (those have been filed by the petitioner in this Writ Petition in Annexure-5 series) along with the certified copy of this Judgment for the hearing of the G.I.A. Case No.513/2011 before the State Education Tribunal, Odisha and the State Education Tribunal, Odisha shall dispose of the G.I.A. Case No.513/2011 as well as the G.I.A Case No.84/2011 within a period of 3 months after giving opportunity of being heard to the learned counsels of both the sides. WP(C) No.2050 of 2026 5.
