NARASINGH Order No. ORDER 19.05.2026 03. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is an accused in connection with T.R. Case No.59 of 2004, pending in the Court of learned Addl. Sessions Judge-cum-Judge (Special Court), Sambalpur arising out of Ainthapali P.S. Case No.179 of 2017, for commission of alleged offences U/s- 20 (b)(ii)(C)/29 of NDPS Act. 3. Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. Case is pending in any other Court. 4. Being aggrieved by the rejection of his application for bail U/s. 483 of the BNSS by the learned 1st Addl. Sessions Judge-cum-Judge (Spl. Court), Sambalpur by order dated 18.02.2026, the present BLAPL has been filed. 5. The allegation against the present Petitioner is that he is involved in the transportation of contraband to the tune of 40 kgs 80 grams. 6. Learned counsel for the Petitioner seeks bail, inter alia, on the ground of delay in trial. 7. It is stated by the learned counsel that since the Petitioner was taken to custody on 15.06.2017, he may be enlarged on bail. 8. Learned counsel for the State opposes the prayer for bail, inter alia, on the ground of the bar contained under Section 37(1)(b)(ii) of NDPS Act and as well as it is submitted that this Court by order dated 28.09.2022 had granted interim bail to the Petitioner for a period of three months and since the Petitioner misused the trust reposed in him and did not surrender, NBW(A) was issued in execution of which he was taken into custody on 09.05.2025. Thereafter, the Petitioner had moved this Court in BLAPL No.6320 of 2025 which was permitted to be withdrawn by order dated 30.07.2025. 9. Considering the nature of allegation and rigors of Section 37(1)(b)(ii) of NDPS Act as well as the conduct of the Petitioner, this Court is not inclined to entertain the bail application. 10. Accordingly, the BLAPL stands disposed of. Learned Trial Court is requested to expedite the trial. (V. NARASINGH) Judge Soumya
