The Petitioners is an accused in connection with T.R. Case No.05 of 2026, pending on the file of learned Sessions Judge-cum-Special Judge, Rayagada, arising out of Rayagada GRPS Case No.0007 of 2026 for commission of the alleged offence under Section 20(b)(ii)B of NDPS Act. 3. Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioners relating to the aforementioned P.S. case is pending in any other Court. 4. Being aggrieved by the rejection of his application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Special Judge, Rayagada by order dated 18.02.2026 in the aforementioned case, the present BLAPL has been filed. 5. The allegation against the Petitioners is they are involved in transportation of contraband to the tune of 15Kg 520gm (Ganja). 6. It is submitted by the learned counsel for the Petitioners that since the contraband is less than the commercial quantity, the Petitioners may be released on bail. 7. Learned counsel for the State opposes the prayer for bail. 8. Considering the nature of allegations regarding the transportation of contraband to the tune of 15Kgs 520gm (Ganja) which is less than the commercial quantity, this Court is not inclined to entertain this bail application during the currency of investigation and taking into account the submission of the learned counsel for the State that the Petitioners are at flight risk. 9. Liberty is granted to the Petitioners to renew their prayer before the learned Court in seisin on submission of final form. 10. It is needless to state that on such submission the learned Trial Court consider the same on its own merit. 11. Accordingly, the BLAPL stands disposed of. 12.
