CMP(M) No. 2043 of 2025 The application for condonation of delay has been filed by the present applicants, who were defendants No. 1, 2, 4, 6, 8 and 10 in the civil suit. Their application for counterclaim against the plaintiff was rejected on the ground of pecuniary jurisdiction, and they were relegated to avail the appropriate remedy before the competent Court. The contesting respondents have put in appearance and have objected to the application seeking condonation of delay of 231 days in filing the appeal against the order dated 25th October, 2024. Keeping in view the averments made in the application that appellant No. 1 is an elected President/Pradhan of the local Panchayat and remained occupied, and further considering that the appellants are the residents of Kangra District, we are of the considered opinion that the opposite side can be compensated by costs for the delay in filing the appeal. Accordingly, the application is allowed, and the delay in filing the appeal is condoned, subject to payment of costs of Rs. 10,000/- to respondent No. 1. Application stands disposed of.
