Swain, AGA CORAM: JUSTICE V. NARASINGH Order No. ORDER 22.04.2026 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is an accused in connection with C.T. Case No.20 of 2026, pending on the file of learned GNA-cum-J.M.F.C., Komna, arising out of Komna P.S. Case No.20 of 2026 for commission of the alleged offence under Sections 69/ 88/ 115(2)/ 351(2)/ 3(5) of BNS. 3. The case of the prosecution is that on dated 25.01.2026 at 9:30 pm, the informant presented a written report alleging that for about last two years, the Petitioner-accused by giving false assurance of marriage kept intimate relationship with her and as a result she become pregnant. Thereafter, by making her consume some kind of medicine to terminate her child in her womb, gave false promise of marriage and asked her to remain silent. When the informant again told about her pregnancy, the Petitioner said he could not do anything. Thereafter, the Petitioner took her from the Pendraban road to Boldha village and abused her physically and abandoned her on the Pendraban jungle road. On the said day the informant went to the house of the Petitioner where the parents as well as sister of the Petitioner threatened and assaulted her. Basing on such report the aforesaid P.S. Case has been registered. 4. Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court. 5. Being aggrieved by the rejection of his application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Sessions Judge, Nuapada by order dated 09.02.2026 in the aforementioned case, the present BLAPL has been filed. 6. It is submitted by the learned counsel for the Petitioner that the Petitioner is in custody since 25.01.2026, he may be released on bail. 7. It is also submitted that in the meanwhile charge sheet has been filed on 24.03.2026. 8. Learned counsel for the State opposes the prayer for bail. 9. This Court perused the statement of the victim recorded under Section 183 of BNSS. 10. On consideration of materials on record including the statement of the victim recorded under Section 183 of BNSS, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin. 11. Accordingly, the BLAPL stands disposed of. 12. Urgent certified copy of this order be granted as per rules. (V. NARASINGH) Judge Ayesha
