IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.2032 of 2026 Raja @ Rajat Rout …. Petitioner Mr. B. Dalai, Advocate -Versus- State of Odisha …. Opposite Party Mr. M.K. Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 16.04.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Jagatsinghpur P.S. Case No.296 of 2015 corresponding to G.R. Case No.997 of 2015 pending in the file of learned S.D.J.M., Jagatsinghpur on the grounds stated therein. 3. Perused the FIR as at Annexure-1. This Court finds that the alleged incident is of the year 2015. It is stated that the petitioner was not present during the alleged incident when it took place. The bail orders in ABLAPLs in respect of the co- accused persons are at Flags-A, B & C. The petitioner is alleged of having committed the mischief along with the co- accused persons, but according to learned counsel for the petitioner, no one is named in the FIR. On perusal of the FIR, this Court further finds that unknown miscreants committed excess and fired the gun shot. Considering the submissions of the learned counsel for the respective parties, this Court is not inclined to consider the plea of pre-arrest bail but allows the petitioner to surrender before the learned court below seeking regular bail claiming parity on account of release of the co- accused persons. 4. Accordingly, it is ordered. 5. In the result, ABLAPL is disposed of. It is further directed that in the event, the petitioner surrenders within a period of fortnight from today before the learned S.D.J.M., Jagatsinghpur in connection with Jagatsinghpur P.S. Case No.296 of 2015 corresponding to G.R. Case No.997 of 2015 and moves an application for regular bail, it shall be duly disposed of in the light of the above order keeping in view the claim of parity. 6. Issue urgent certified copy as per rules. (R.K. Pattanaik) Judge Alok
