IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No. 2031 of 2026 Narmada Behera …. Petitioner Mr. D.J. Sahoo, Advocate -versus- State of Odisha …. Opposite Party Mr. C.R. Swain, AGA CORAM: JUSTICE V. NARASINGH Order No. ORDER 22.04.2026 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is an accused in connection with Spl. G.R. Case No.03 of 2026 (NDPS), pending on the file of learned Addl. Sessions Judge-cum-Special Judge, Bhanjanagar, arising out of Bhanjanagar P.S. Case No.96 of 2026 for commission of the alleged offence under Section 20(b)(ii)(C) of NDPS Act. 3. Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court. 4. Being aggrieved by the rejection of his application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Special Judge, Bhanjanagar by order dated 12.02.2026 in the aforementioned case, the present BLAPL has been filed. 5. The allegation against the Petitioner is that he was involved in the transportation of contraband (ganja) to the tune of 26.280Kg. 6. Learned counsel for the State opposes the prayer for bail. 7. Keeping in view the rigors of Section 37(1)(b)(ii) of the NDPS Act, since admittedly the investigation is still in progress, this Court is not inclined to entertain this application for bail at this stage. 8. Liberty is granted to the Petitioner to renew his prayer before the learned Court in seisin, which shall be considered on its own merit. 9. Accordingly, the BLAPL stand disposed of. (V.
