IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.2027 of 2026 Prakash @ Prakash Sahoo …. Petitioner Mr. Soumya Ranjan Das, Advocate -Versus- State of Odisha …. Opposite Party Mr. M.K. Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 15.04.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Rourkela Plantsite P.S. Case No.92 of 2026 corresponding to G.R. Case No.296 of 2026 pending in the file of learned S.D.J.M., Panposh at Rourkela on the grounds stated therein. 3. Perused the FIR as at Annexure-1. It is submitted to the Court by Mr. Das, learned counsel for the petitioner that the co- accused persons have been arrested in connection with this case, hence, there is apprehension of such arrest and therefore, the ABLAPL. 4. Recorded the submission of learned counsel for the State. 5. A copy of the order of the learned S.D.J.M., Panposh in G.R. Case No.296 of 2026 is produced by the learned counsel for the petitioner to claim that the other accused persons are arrested by the local police. Considering the submissions as above and though the offences are bailable in nature, hence, the ABLAPL is not maintainable but in view of the arrest of the co- accused persons, this Court is inclined to direct the petitioner to surrender before the learned court below for being released on bail with conditions instead of granting pre-arrest bail as demanded by him. 6. Accordingly, it is ordered. 7. In the result, the ABLAPL is disposed of. It is directed that in the event, the petitioner surrenders within a fortnight from today before the learned S.D.J.M., Panposh at Rourkela in connection with Rourkela Plantsite P.S. Case No.92 of 2026 corresponding to G.R. Case No.296 of 2026, he shall be released on bail subject to him on furnishing bail bond of Rs.20,000/- (Rupees twenty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. 8. Issue urgent certified copy as per rules. (R.K. Pattanaik) Judge Alok
