W.A. No. 2027 of 2025
State of Odisha and Others …. Appellants Mr. Satya Brata Mohanty, AGA
-versus-
Arun Kumar Pradhan …. Respondents
CORAM:
JUSTICE KRISHNA SHRIPAD DIXIT
JUSTICE CHITTARANJAN DASH
ORDER
Order No. 18.03.2026
01.
W.A. No. 2027 of 2025 & I.A. No.4617 2025
This Intra-Court Appeal by the State and its official seek to call in question a learned Single Judge’s
order dated 20.11.2023 entered in Respondent- employee’s WPC No.36827 of 2023 whereby relief has been accorded as under:
“In view of the aforesaid facts and circumstances, the present writ petition is allowed and the Opposite Parties are directed to grant similar benefits to the Petitioner as has been done in the case of Narusu Pradhan vide order dated 11th June, 2009 passed in O.A. No.1189© of 2006. The Petitioner is directed to appear before the Opposite Party No.4 along with certified copy of this order and all other relevant documents and records for the processing of his claim. The Opposite Party No.4 upon receipt of certified copy of this order shall calculate and pay the
benefits payable to the Petitioner, particularly his pensionary benefits, within a period of three months from the date of production of certified copy of this order. 14. With the aforesaid observation, the writ petition is allowed. There shall no order as to cost.”
2. The Appeal has been filed after brooking a long delay of 712 days and an application supported by affidavit accompanies the Appeal Memo seeking its condonation. We have perused the application and the accompanying affidavit as filed. It is parrot like thins have been repeated here also. Rarely, we come across an Appeal of the kind filed by the State within the period of limitation. Delay is too long and explanation offered for the same is not plausible. Therefore, we decline to interfere in the application. 3. The above being done, still we have undertaken to examine the matter on merits. The subject matter of this Appeal is substantially similar to the one in W.A. No.1131/2024 between State of Odisha vs. Narasingha Choudhury disposed off on 29.01.2026 wherein Appeal of the kind has been dismissed and therefore, on the principle of parity, this Appeal too has to meet the same fate. In the above circumstances, the Appeal as well as the delay application are rejected in limine. The
Appellants to implement the impugned order of the learned Single Judge and report compliance to the Registrar General of this Court within an outer limit of three months without driving the Respondent to avoidable contempt proceedings. Registry to send a copy of this to the private Respondent by speed post immediately.
