Pathak, APP ------ 2/21.01.2026 Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State. 2. The petitioner is apprehending his arrest in connection with Nawadih P.S. Case No.23 of 2025, registered under Sections 126(2), 115(2), 117(2), 109, 352, 351(3), 74 of BNS, pending in the Court of learned ACJM, Bermo at Tenughat. 3. Learned counsel appearing for the petitioner submits that the alleged occurrence is said to be taken place on 14/03/2025, whereas the FIR has been lodged on 20th March 2025. She submits that the false allegation is made of molestation and the nature of injury report has not been given by the doctor as the CT scan of the brain was not done. She also submits that the petitioner has got no criminal antecedents as disclosed in Para 11 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegation of assault is there and the injury has also been received. 5. Considering that alleged date of occurrence is 14/03/2025 and 2026:JHHC:1606 2 the FIR has been lodged on 20th March 2025 and the doctor has not given the report on the point of injury as disclosed by the learned counsel appearing for the petitioner by way of placing paragraph No. 60 of the case diary, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned ACJM, Bermo at Tenughat in connection with Nawadih P.S. Case No.23 of 2025, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. 7.
