JUSTICE K.MANMADHA RAO ORAL ORDER Learned counsel for the petitioner and learned counsel for the respondents are present. 2. This matter was referred to the Karnataka Mediation Centre, Bengaluru for mediation and the matter was settled between the parties. The mediation report was also received from the Karnataka Mediation Centre and the same reads as under: - 4 - HC-KAR NC: 2026:KHC:13165 RPFC No. 115 of 2024 C/W RPFC No. 193 of 2025 “1. Both parties state that their marriage was solemnized on 05.02.2015 at Sri Mahalakshmi Temple, Goravanahalli, Koratagere Taluk, Tumkuru District as per Hindu rites and customs. Further both the parties state that they have a son by name Master Tushar aged about 9 years who is presently under the care and custody of the Respondent No.1/Mother and continues to be so in future for which the petitioner/father has no objection. 2. In view of the parties prosecuting the cases against each other, their relationship is strained and that they are not able to live together as husband and wife and they have reached a point of no return and the marriage between them has broken down irretrievably. As such they have decided to get their marriage dissolved by filing a mutual consent petition on or before 15th October 2025. 3. The Petitioner has agreed to pay a sum of Rs.9,50,000/-(Rupees Nine Lakhs Fifty Thousand Only) to the Respondent No.1 as full and final settlement of all her claims of maintenance/permanent alimony. The Respondent No.1 has agreed to accept the said sum as full and final settlement of all her claims of maintenance/permanent alimony. The Petitioner has agreed to pay the said amount in the following manner: a) A sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand Only) will be paid by the Petitioner to the Respondent No.1 at the time of filing the mutual consent petition for dissolution of their marriage on or before 15th October 2025. b) The balance amount of Rs.7,00,000/- (Rupees Seven Lakhs Only) will be paid by the Petitioner to the Respondent No.1 on or before 15th January - 5 - HC-KAR NC: 2026:KHC:13165 RPFC No. 115 of 2024 C/W RPFC No. 193 of 2025 2026 by way of online transfer to the account of the Respondent No.1 bearing A/c No.110164453434, Canara Bank, Antharasanahalli Branch, Tumkur, IFSC Code: CNRB005075. 4. In view of this settlement both the parties have agreed to withdraw/close/quash the following pending cases in accordance with law: i) Crl.Misc No.287/2023 filed by the Respondent No.1 against the Petitioner pending on the file of I Addl. Family Court, Tumkuru. ii) C.C.No.4722/2022 filed by the Respondent No.1 under section 498A of IPC against the petitioner and his family members pending on the file of II Addl. Senior Civil Judge, Tumkuru. iii) Crl.P.No.3088/2025 filed by the Petitioner pending on the file of Hon'ble High Court of Karnataka, Bengaluru. iv) W.P.No.35766/2024 filed by the Petitioner pending on the file of Hon'ble High Court of Karnataka, Bengaluru. 5. Both the parties state that the Respondent No.2 Master Tushar has filed a suit for partition through natural guardian mother in O.S.No.318/2022 against the petitioner which was also decreed declaring that the Respondent No.2 is entitled for 1/2 share in the 1/3rd share of the petitioner's ancestral properties against which FDP No. 65/2024 pending on the file of 1st Addl. Senior Civil Judge, Tumkuru. The Petitioner and his father and his sister has challenged the said decree in RFA No. 2384/2024 which is pending on the file of Hon'ble High Court of Karnataka, Bengaluru. In view of the same the Petitioner is not paying any maintenance for the minor son Master. Tushar and his right is - 6 - HC-KAR NC: 2026:KHC:13165 RPFC No. 115 of 2024 C/W RPFC No. 193 of 2025 subject to the result of RFA pending before this Hon'ble Court. 6. Both the parties state that apart from the above they do not have any claim against each other in respect of maintenance and alimony, either present, past or in future as also in respect of the properties held by each one of them either in the present or to be held in future. 7. Both parties state that they will not interfere with each other in future and make a peaceful living without resorting to filing of cases or complaint/s. 8. The parties further state that there has been no collusion or force, fraud or any undue influence by any of the parties to enter into this into this compromise in the aforesaid manner”. 3.
