The petitioner has prayed for expeditious disposal of M. Ex. Case No.24 of 2025 presently pending before learned Additional Chief Judicial Magistrate, Diamond Harbour. Being aggrieved by the delay in disposal of the proceeding, learned Counsel for the petitioner submits that the petitioner by filing an application under Section 125 of the Cr.P.C. read with Section 144 of BNSS obtained an interim maintenance order of Rs.4,000/- per month till disposal of the case. On 17th April, 2025 petitioner filed aforesaid M.Ex. case under Section 125(3) of the Cr.P.C. for recovery of sum of Rs.48,000/- which became due on and from 1st April, 2024 till 31st March, 2025. The said proceeding is still pending and petitioner prays for a direction upon the Court below for taking appropriate steps for expeditious disposal of the execution proceeding. Having heard learned Counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if it is allowed, the opposite party will have no cause to prejudice and, as
2 such, service of copy of application upon the opposite party is dispensed with. Having considered the submission made on behalf of the petitioner, the instant application being CRR 1261 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the case by taking appropriate steps under the law and to make its best effort to conclude the execution proceeding preferably within a period of 3 months from the next date of hearing. This order is passed invoking this Court’s jurisdiction under Section 529 of the BNSS.
