The petitioner is apprehending his arrest in connection with Chanho P.S. Case No.83 of 2022, registered under sections 379, 411 of BNS, 2023, Rules 4, 9, 11 of Jharkhand Minerals (Prevention of illegal Mining Transportation and Storage) Rules, 2017 and Rules 4, 54 of the J.MMC (Jharkhand Minor Mineral Concession), Rules, 2004, pending in the Court of learned Judicial Magistrate, Ist Class, Ranchi. 3. Learned counsel for the petitioner submits that petitioner is driver of one of the tractor and allegations are made that 12 tractors were intercepted carrying illegal sand. He next submits that owners of the different vehicles have been granted anticipatory bail in A.B.A. No. 6594 of 2022 and A.B.A. No. 6479 of 2022 and other co-accused persons have been granted anticipatory bail in A.B.A. No. 6357 of 2022 contained in annexure-2 series. He submits that petitioner has no criminal antecedent which is disclosed in para 14 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that illegally sand was being carried out. 5. Considering that petitioner is driver of one of the tractor and ( 2026:JHHC:13102 ) owners of the different vehicles and other co-accused persons have been granted anticipatory bail in the aforesaid A.B.As contained in annexure-2 series. The petitioner has no criminal antecedent which is disclosed in para 14 of the petition. 6. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Ranchi, in connection with Chanho P.S.
