State Of Rajasthan, Through Principal Secretary, Department Of Water Resources, Government Of Rajasthan, Govt. Secretariat, Jaipur. 2. Director And Officiating Special Secretary To Government, Directorate Of Water Shed And Soil Conservation, Rajasthan, Jaipur. 3. Superintending Enginee Cum Paden Project Manager, Water Shed Cum Data Center, Zila Parishad Building, Jhalawar. 4. Assistant Engineer (Pia), Water Resources Cum Soil Conservation, Panchayat Samiti Dug, Distt. Jhalawar. ----Respondents For Petitioner(s) : Mr. Pradeep Singh HON'BLE MS. JUSTICE REKHA BORANA Order 14/07/2026 1. The present writ petition has been filed aggrieved of order dated 10.08.2024 (Annexure-12) whereby the representation as filed by the petitioner in pursuance to order dated 13.02.2024 passed in the earlier writ petition (S.B. Civil Writ Petition No.20569/2023) (Annexure-11) filed by him, stood rejected. 2. The case of the petitioner was that he had worked on contractual basis from 21.06.2016 to 30.09.2016 and further from 09.01.2017 to 31.10.2018, hence, he ought to have been [2026:RJ-JP:26540] (2 of 2) [CW-17972/2024] governed by the Rajasthan Contractual Hiring to Civil Post Rules, 2022 (hereinafter referred to as 'Rules of 2022'). 3. Vide order dated 13.02.2024, the petitioner was granted liberty to file a representation before the respondent-Authorities. 4. The representation as filed by the petitioner has been rejected on the ground that he had been in contractual services only till the year 2018 whereas the Rules of 2022 were applicable only to the persons working on contractual basis on the date of commencement of the said rules. 5. Admittedly, Rules of 2022 came into effect from 11.01.2022. It is an admitted fact that the petitioner last worked on contract basis till the month of October 2018. In view of the said admitted fact and in terms of Rule 3 of the Rules of 2022, the petitioner definitely could not have been considered or governed by the said rules. The representation of the petitioner has rightly been rejected. 6. No case for interference is made out and the writ petition is hence, dismissed. 7. Stay petition and pending application(s), if any, stand disposed of. (REKHA BORANA),J 96/ANMOL
