(2) Since the issue involved in both the writ petitions is identical, therefore, these are being heard and decided together by this common judgment. However, for brevity, facts of Writ Petition (S/S) No. 2126 of 2022 alone are being considered and discussed here. (3) This writ petition is filed by Manager of Janta Junior High School, Haluni, District Pauri Garhwal, challenging the order dated 8.8.2022, passed by District Education Officer, Elementary, Pauri Garhwal. By the said order, Management of the said school was informed that upon expiry of three months from the date of advertisement, permission granted to hold the selection for supplying available vacancies on teaching posts stands cancelled. (4) Learned State Counsel submits UKHC010128772022 2026:UHC:6922 that the impugned order has been passed as per the relevant regulations, framed under Uttarakhand School Education Act. (5) This Court finds substance in the said contention. Since as per the regulations, selection process has to be completed within three months, therefore, there is no illegality or infirmity in the impugned order. Thus there is no scope for interference in the matter. Writ petitions are, however, disposed of with liberty to petitioners to seek fresh permission for advertising the vacancies, if already not supplied. If petitioners make such application within ten days from today, competent authority shall take decision thereupon, as per law, within six weeks thereafter.
