On the oral request of the counsel for the applicant, he is permitted to implead Mr. Devi Prasad Pal (Chairman), Chief Development Officer, Chitrakoot, as opposite party no. 2 during the course of the day. 2. The present contempt application has been preferred alleging willful defiance of the order dated 03.12.2025 passed in Writ-A No. 18255 of 2025, order whereof is quoted hereunder:- "1. Heard learned counsel for the petitioner. Learned Standing Counsel has accepted notice on behalf of respondents no.1, 2, 4 & 5, Sri Shivendra Kumar Singh, learned counsel has accepted notice on behalf of respondent no.3 and Sri Dinesh Chandra Kesarwani, learned counsel has accepted notice on behalf of respondent nos.2 & 4. 2. The final list of selection for the post of Academic Resource Person (ARP) dated 12.11.2025 in so far as it relates to selection of respondent no.6 is concerned is under challenge in the present writ petition. 3. It is argued by counsel for the petitioner that respondent no.6 is not qualified for his appointment on the aforesaid post in view of the Government Order dated 22.10.2019. In paragraph-18 of the writ petition it is stated that respondent no.6 is B-Tech hence he is not eligible for applying for the aforesaid post. 4. Heard learned counsel for the parties and perused the records. 5. From perusal of the records it transpires that petitioner is aggrieved against the selection of the respondent no.6 on the aforesaid post on the ground that he is not qualified for the aforesaid post. 6. After hearing counsel for the parties and after perusal of the records, the Court is Versus Counsel for Applicant(s) : Rishabh Kumar Pandey, Yog Maya Gautam Counsel for Opposite Party(s) : Yatindra Radhey Shyam Singh .....Applicant(s) Shri Surendra Tiwari Presently Posted As Secretary, Basic Education Parishad .....Opposite Party(s) of the opinion that this factual controversy could not be resolved by this Court specially under Article 226 Constitution of India. 7. In the facts and circumstances, petitioner is permitted to submit a fresh representation ventilating all his grievances before the respondent no.2-Secretary, Basic Shiksha Parishad, U.P., Prayagraj along-with certified copy of this order within a period of two weeks from today. If such a representation is made, the respondent no.2 is directed to pass appropriate order in accordance with law after providing opportunity of hearing to the respondent no.6 within next six weeks from the date of receipt of certified copy of this order. 8. With the aforesaid observations, present writ petition is disposed of finally. 9. Since the writ petition has been decided on an exparte version without seeking any response from the respondents, thus the passing of the order today may not be construed to an expression that this Court has gone into the merits of the matter and the second respondent shall accord independent consideration strictly in accordance with law and the mandate of law holding the field." 3. This Court on 07.07.2026 proceeded to pass the following order:- "Let a copy of the contempt application be served upon Sri Brijesh Kumar, learned Standing Counsel who shall seek instructions. Put up this case on 04.08.2026 as fresh." 4. Thereafter on 04.08.2026 the following order was passed:- "Sri Brijesh Kumar, learned Standing Counsel submits that a letter has been sent for seeking instructions but he has not received instructions. Put up this case on 21.08.2026 as fresh, by which time, he shall obtain instructions." 5. On 21.08.2026 following order was passed:- "1. Let a copy of the contempt application be served upon Sri Yatindra (AoR No. A/Y 0026/2012), who appear for the opposite party, during the course of the day. 2. Put up this case on 14.09.2026, as fresh. 3. When the case is next listed, name of Sri Yatindra be shown from the opposite side." 6. On 14.09.2026, following order was passed:- "1. Today, when the matter has been taken up, Sri Yatindra, learned counsel, submits that the opposite party has passed an order dated 02.09.2026, according to which, respondent no. 5 in Civil Misc. Writ Petition No. 18255 of 2025, District Selection CAPL No. 3875 of 2026 2 Committee, Academic Resource Person (ARP), Chitrakoot, is the competent person to decide the claim. 2. On being asked as to from which source the same can be determined, Sri Yatindra submits that it is as per the Government Order dated 22.10.2019. 3. Sri Yatindra was asked to place the Government Order dated 22.10.2019 before this Court but he is not in possession of the same. 4. Put up this case on 30.09.2026 as fresh, by which time the said Government Order shall be placed before this Court. 5. The order dated 02.09.2026 is taken on record and shall be marked as Appendix 'A'." 7. In the order dated 14.09.2026, Sri Yatindra who was served with the copy of the contempt petition had produced before this Court an order dated 02.09.2026 of the opposite party no.2 who happens to be Secretary, Basic Education Parishad, U.P. at Prayagraj, wherein a stand had been taken that with respect to the grievances so raised by the applicant relating to Academic Resource Person (ARP), the same is to be decided by a Committee, which comprises of five officers being: (1) Chief Development Officer - Chairman, (2) Principal, District DIET - Member, (3) District Basic Education Officer - Secretary / Member, (4) District Coordinator (Training) - Member, (5) Senior Block Education Officer - Member. 8. Today, Government Order has been produced dated 22.10.2019 so as to show that the opposite party being the Secretary of the Basic Education Parishad, U.P. at Prayagraj is not concerned for taking a decision and the Committee is to take a decision. 9. I have heard the counsels for the parties and perused the record carefully. 10. The order of the Writ Court accorded liberty to the applicant to file a fresh representation before the respondent no. 2, Secretary, Basic Shiksha Parishad, U.P. Prayagraj along with the certified copy of the order and the said authority being opposite party herein was to decide the same after hearing the respondent no.6 i.e. Deepak Kumar Gupta, Assistant Teacher, within a period of six weeks from the date of receipt of the order. CAPL No. 3875 of 2026 3 11. The allegation of the applicant is that despite filing of representation, the same has not been decided. The array of parties in the writ petition in so far as respondents are concerned is quoted hereunder:- "1. State of U.P. through its Principal Secretary, Basic Education, Government of U.P. at Lucknow. 2. Secretary, Basic Shiksha Parishad, Uttar Pradesh at Prayagraj. 3. Director, School Shiksha Evam Rajya Pariyojana Nideshak, Vidhya Bhawan, Nishantganj, Lucknow. 4. District Basic Education Officer, District Chitrakoot. 5. District Selection Committee Academic Resource Person (ARP), Chitrakoot.6. Deepak Kumar Gupta, Assistant Teacher, Selected candidate for ARP working as Assistant Teacher in Primary School, Tamrar, Ram Nagar, Chitrakoot. ....Respondents" 12. A bare look at paragraph no.1 of the judgment and order of the Writ Court dated 03.12.2025 would go to show that learned Standing Counsel appeared for Principal Secretary, Basic Education, Government of U.P., Lucknow /Respondent No.1, Secretary, Basic Shiksha Parishad, Uttar Pradesh at Prayagraj/Respondent No.2, District Basic Education Officer, District Chitrakoot/Respondent No.4, and District Selection Committee, Academic Resource Person (ARP), Chitrakoot was represented by learned Standing Counsel and Sri Shivendra Kumar Singh appeared for Director, School Shiksha and State Project Director, Vidya Bhawan, Nishadganj, Lucknow and Sri Dinesh Chand Kesarwani for Secretary, Basic Shiksha Parishad, Uttar Pradesh at Prayagraj and District Basic Education Officer, District Chitrakoot. 13. Interestingly, notice on behalf of Secretary, Basic Shiksha Parishad, Uttar Pradesh at Prayagraj and District Basic Education Officer, District Chitrakoot was received by learned Standing Counsel as well as by Sri Dinesh Chand Kesarwani. 14. On 02.09.2026, an order came to be passed by the opposite party, Secretary, Basic Education Parishad, U.P. at Prayagraj, who happened to be Respondent No.2 in the writ petition, whereby a stand was taken that the Committee so constituted as per the Government Order dated CAPL No. 3875 of 2026 4 22.10.2019 is to decide the said issue. For ready reference, the order dated 02.09.2026 is quoted hereunder:- "मा0 उच्च न्यायालय में योिजत यािचका संख्या 18255/2025 राधेश्याम िसह बनाम उत्तर प्रदेश राज्य एवं 05 अन्य में पािरत आदेश िदनांक 03.12.2025 के अनुपालन में याची द्वारा प्रस्तुत अपील का िनस्तारण :- श्री राधे श्याम िसह सहायक अध्यापक कन्या उच्च प्राथिमक िवद्यालय रूपौली क्षेत्र रामनगर जनपद िचत्रकू ट द्वारा मा0 उच्च न्यायालय में योिजत यािचका संख्या 18255/2025 राधेश्याम िसह बनाम उत्तर प्रदेश राज्य एवं 05 अन्य में पािरत आदेश िदनांक 03.12.2025 के अनुपालन में अपने अपील के साथ संलग्न कर प्रस्तुत की गयी। िजसमें मा0 न्यायालय द्वारा िनम्नवत आदेश पािरत िकये गये है :- 1. field. प्रकरण के िनस्तारण हेतु पिरषद कायार्लय के पत्र संख्या बे0िश0प0/21968-69/2025-26 िदनांक 20.02.2026 द्वारा सुनवाई की ितिथ 12.03.2026 िनधार्िरत करते हुये िजला बेिसक िशक्षा अिधकारी िचत्रकू ट को प्रकरण से सम्बिन्धत आख्या तथा अपीलाथीर् को अपना पक्ष प्रस्तुत िकये जाने के िनदेर्श िदये गये। अपीलाथीर् उपिस्थत हुये और अपना पक्ष प्रस्तुत िकया गया तथा िजला बेिसक िशक्षा अिधकारी के प्रितिनिध श्री एन0पी0 िसह खण्ड िशक्षा अिधकारी िवकास खण्ड रामनगर िचत्रकू ट द्वारा आख्या पत्रांक 11455-458/2025-26 िदनांक 10.03.2026 प्रस्तुत िकया गया। अपीलाथीर् द्वारा अनुरोध िकया गया है िक प्राथीर् द्वारा ए0आर0पी0 (िवज्ञान) चयन जनपद िचत्रकू ट के सम्बन्ध में उपयुर्क्त वाद में मा0 उच्च न्यायालय द्वारा िदनांक 03.12.2025 को पािरत आदेश के अनुपालनाथर् यह अिन्तम अभ्यावेदन प्रस्तुत िकया जा रहा है। मा0 न्यायालय ने प्रितवादी संख्या-2 को िनदेर्िशत िकया गया है िक प्राथीर् के अभ्यावेदन पर िवचार कर कारण युक्त आदेश पािरत करें। प्रकरण के तथ्य एवं चयन प्रिक्रया में हुई गम्भीर अवैधतायें हैं। 1- प्राथीर् की िवज्ञान िवषय योग्यता एवं चयिनत अभ्यथीर् श्री दीपक कु मार गुप्ता की अयोग्यता :- प्राथीर् बी0एस0सी0 (वनस्पित िवज्ञान, जन्तु िवज्ञान, रसायन िवज्ञान) स्नातक है, जो ए0आर0पी0 िवज्ञान हेतु अपेिक्षत िवषय िवशेषज्ञता के पूणर्तः अनुरूप है। जब िक िजला बेिसक िशक्षा अिधकारी, िचत्रकू ट के आदेश पत्रांक /7072-79/2025-26 िदनांक 12.11.2025 के क्रम संख्या 02 चयिनत अभ्यथीर् श्री दीपक कु मार गुप्ता बी0टेक0 (इंजीिनयिरग) धारक है। जो शासनादेश 22.10.2019 के अनुसार िवज्ञान िवषय िवशेषज्ञता की श्रेणी में नहीं आते हैं। अतः अयोग्य अभ्यथीर् का चयन िनयम िवरुद्ध है, एवं िजला बेिसक िशक्षा अिधकारी, िचत्रकू ट के आदेश पत्रांक गुण0/िव0/5719-25/2025-26 िदनांक 04.10.2025 के क्रम संख्या-6 पर अिभमन्यु िसह की योग्यता स्नातक पी0सी0एम0 से है। जब िक शासनादेश 22.10.2019 में िवज्ञान ए0आर0पी0 पद हेतु स्नातक बी0एस0सी0 जन्तु, वनस्पित एवं रसायन िवज्ञान अहर्ता है। 2- प्राथीर् द्वारा दो बार िलिखत एवं माइक्रो-टीिचग उत्तीणर् - प्राथीर् ने ए0आर0पी0 चयन प्रिक्रया में दोनो अवसरों पर िलिखत परीक्षा 60 प्रितशत से अिधक माइक्रो-टीिचग 60 प्रितशत से अिधक अंक प्राप्त कर उत्तीणर् िकया जो उनकी िवषय क्षमता एवं पात्रता िसद्ध करता है। 3- के वल साक्षात्कार में मनमाने अंक देकर अपात्र घोिषत िकया जाना - दोनो अवसरों पर प्राथीर् को के वल साक्षात्कार में 46 प्रितशत से कम अंक देकर अनुत्तीणर् घोिषत िकया गया, जब िक वह िलिखत एवं माइक्रो- टीिचग में सक्षम पाया गया। यह चयन प्रिक्रया में व्यिक्तपरकता, पक्षपात एवं मनमाने मूल्यांकन का संके त है। 4- शासनादेश 22.10.2019 के िविडयो िरकािडग प्रावधान का उल्लंघन- शासनादेश के अनुसार िलिखत माइक्रो-टीिचग एवं साक्षात्कार की िविडयो िरकािडग करायी ही नहीं गयी। अतः साक्षात्कार अंकन की पारदिशता समाप्त हो गयी तथा चयन प्रिक्रया का सत्यापन असम्भव हो गया। िजससे सम्पूणर् चयन प्रिक्रया संदेहास्पद एवं दूिषत हो गयी। 5- िलिखत माइक्रो-टीिचग अंक एवं साक्षात्कार के अंक घोिषत न िकया जाना- प्राथीर् को न तो िलिखत परीक्षा एवं न ही माइक्रो-टीिचग के अंक िकसी स्तर पर घोिषत अथवा उपलब्ध कराये गये। साक्षात्कार अंक भी िकसी अिभलेख या पत्र के माध्यम से न देकर के वल मौिखक रूप से लगभग 46 प्रितशत बताये गये। अतः अंक प्रिक्रया अपारदशीर् है, जो चयन प्रिक्रया को अवैध एवं अिवश्वसनीय बनाता है। 6- िवज्ञिप्त में िबन्दु संख्या-23 का अवैध समावेश- कायार्लय िजला बेिसक िशक्षा अिधकारी िचत्रकू ट के िवज्ञिप्त आदेश पत्रांक 2428-34/2025-26 िदनांक 04.07.2025 के िबन्दु 23 प्रथम चयन में प्राथीर् को CAPL No. 3875 of 2026 6 साक्षात्कार में अनुत्तीणर् करने के पश्चात िरक्त पदों हेतु जारी िवज्ञिप्त में िजला बेिसक िशक्षा अिधकारी िचत्रकू ट द्वारा िबन्दु 23 जोड़ा गया िक पूवर् परीक्षा में असफल अभ्यथीर् आवेदन के पात्र नहीं होंगे। जब िक शासनादेश 22.10.2019 में ऐसा कोई प्रितबन्ध नहीं है िजला स्तर पर पात्रता शतर् जोड़ना अिधकार क्षेत्र से बाहर है। अतः उक्त शतर् अवैध एवं शून्य है। 7- चयन प्रिक्रया की समग्र अवैधता उपरोक्त तथ्यों से स्पष्ट है िक अयोग्य अभ्यथीर् का चयन, साक्षात्कार में मनमाना अंकन, िविडयो िरकािडग प्रावधान उल्लंघन, अंक घोिषत न करना, िवज्ञिप्त में अवैध पात्रता प्रितबन्ध के कारण ए०आर०पी०(िवज्ञान) चयन प्रिक्रया पूणर्तः दूिषत अपारदशीर् एवं िनयम िवरुद्ध है। याची द्वारा बी०टेक अभ्यथीर् श्री दीपक कु मार गुप्ता के चयन को अयोग्यता के आधार पर िनरस्त िकया जाय। प्राथीर् के िलिखत एवं माइक्रो-टीिचग मेिरट के आधार पर पात्रता पर िवचार िकया जाय। अवैध िबन्दु 23 को िनरस्त िकये जाय। प्राथीर् को ए०आर०पी० िवज्ञान पद पर िनयमानुसार चयिनत िकये जाने का अनुरोध िकया गया है। िजला बेिसक िशक्षा अिधकारी िचत्रकू ट ने आख्या पत्रांक 11455-458/2025-26 िदनांक 10.03.2026 द्वारा अवगत कराया गया है िक शासनादेश संख्या-68-5099/143/2024-अनुभाग-5 िदनांक 10 अक्टूबर 2024 एवं शासनादेश संख्या-902/68-5-2019 िदनांक 22 अक्टूबर 2019 के अनुपालन में महािनदेशक, स्कू ल िशक्षा एवं राज्य पिरयोजना िनदेशक, समग्र िशक्षा, उ०प्र० लखनऊ के पत्रांक/गु०िव०/ए०आर०पी०/9333/ 2024-25 िदनांक 15.01.2025 के द्वारा समग्र िशक्षा के अन्तगर्त स्थािपत न्याय पंचायत संसाधन के न्द्रों एवं ब्लॉक संसाधन के न्द्रों के पुनगर्ठन हेतु िनगर्त शासनादेश के क्रम में अकादिमक िरसोसर् पसर्न (ए०आर०पी०) चयन के सम्बन्ध में िनदेर्श प्रदान िकये गये है। शासनादेश िदनांक 22 अक्टूबर 2019 में िनिहत व्यवस्थानुसार अकादिमक िरसोसर् पसर्न (ए०आर०पी०) चयन की कायर्वाही जनपदीय चयन सिमित के अध्यक्ष-मुख्य िवकास अिधकारी, िचत्रकू ट के अनुमोदन िदनांक 12.02.2025 के क्रम में जनपद के समस्त िवकासखण्ड हेतु 25 अकादिमक िरसोसर् पसर्न (ए०आर०पी०) के पद को भरें जाने हेतु अधोहस्ताक्षरी कायार्लय पत्रांक/9134-42/2024-25 िदनांक 05.03.2025 के द्वारा िवज्ञिप्त प्रकाशन की कायर्वाही की गयी। िजसमें श्री राधेश्याम िसह, स०अ०, उ०प्रा०िव० रूपौली, क्षेत्र-रामनगर द्वारा आवेदन िकया गया। शासनादेश के अनुपालन में िलिखत परीक्षा व माइक्रो टीिचग की कायर्वाही की गयी, िजसमें श्री राधेश्याम िलिखत परीक्षा व माइक्रो टीिचग में अहर् पाये गये िकन्तु साक्षात्कार में जनपदीय सिमित द्वारा िदये गये अंकों के आधार पर श्री राधेश्याम को अनहर् घोिषत िकया गया। चयन प्रिक्रया में कु ल 25 पदों के सापेक्ष 13 अकादिमक िरसोसर् पसर्न (ए०आर०पी०) का चयिनत हुये। पुनश्च िरक्त 12 पदों हेतु मुख्य िवकास अिधकारी, िचत्रकू ट के अनुमोदन िदनांक 02.07.2025 के अनुपालन में चयन की कायर्वाही की गयी, इस प्रिक्रया में भी श्री राधेश्याम िलिखत परीक्षा व माइक्रो टीिचग में अहर् पाये गये िकन्तु साक्षात्कार में जनपदीय सिमित द्वारा िदये गये अंकों के आधार पर श्री राधेश्याम को अनहर् घोिषत िकया गया। चयन प्रिक्रया में िरक्त कु ल 12 पदों के सापेक्ष 05 अकादिमक िरसोसर् पसर्न (ए०आर०पी०) का चयिनत हुये। िरक्त 07 पदों की चयन की कायर्वाही गितमान है। उक्त के अितिरक्त याची श्री राधेश्याम िसह द्वारा मा० उच्च न्यायालय में योिजत यािचका संख्या- 18255/2025 में प्राथर्ना की गयी है िक श्री दीपक गुप्ता, स०अ०, प्रा०िव० तमरा, क्षेत्र व जनपद-िचत्रकू ट जो बी०टेक है का चयन अकादिमक िरसोसर् पसर्न (ए०आर०पी०) में िकया गया है, जो िक शासनादेश िदनांक 22 अक्टूबर 2019 में उिल्लिखत िनिहत प्रािवधानों के िवपरीत है, के सम्बन्ध में स्पष्ट करना है िक बेिसक िशक्षा िवभाग के अन्तगर्त कायर्रत िशक्षकों हेतु क्रमशः मात्र 04 िवषय है :- गिणत-िवज्ञान, सामािजक िवषय, CAPL No. 3875 of 2026 7 भाषा िहन्दी, भाषा अंग्रेजी है, िजसमें गिणत व िवज्ञान िवषय से स्नातक करने वाले िशक्षकों को गिणत-िवज्ञान िवषय में रखा गया है, िजससे श्री दीपक गुप्ता भी गिणत-िवज्ञान िवषय के िशक्षक से आच्छािदत है। िजसके दृिष्टगत जनपदीय चयन सिमित द्वारा श्री दीपक गुप्ता को िवज्ञान िवषय के रूप में अकादिमक िरसोसर् पसर्न (ए0आर0पी0) में चयिनत िकया गया है। िजला बेिसक िशक्षा अिधकारी की आख्या तथा याची श्री राधेश्याम िसह द्वारा प्रस्तुत अिभलेख के अनुशीलन से स्पष्ट है िक श्री राधेश्याम िसह द्वारा अकादिमक िरसोसर् पसर्न (ए0आर0पी0) चयन में अिनयिमतता आिद के सम्बन्ध में िशकायत की गयी है। अकादिमक िरसोसर् पसर्न (ए0आर0पी0) चयन की कायर्वाही का अिधकार क्षेत्र इस कायार्लय में िनिहत नहीं है। अतः प्रकरण पर इस कायार्लय द्वारा िनणर्य नहीं िलया जा सकता है। श्री राधे श्याम िसह सहायक अध्यापक कन्या उच्च प्राथिमक िवद्यालय रूपौली क्षेत्र रामनगर जनपद िचत्रकू ट द्वारा प्रस्तुत प्रत्यावेदन उपरोक्तानुसार िनस्तािरत िकया जाता है। (सुरेन्द्र कु मार ितवारी) सिचव उ0प्र0 बेिसक िशक्षा पिरषद, प्रयागराज।" 15. Further, Para 4 sub-clause 3 and 4 of the Government Order dated 22nd October, 2019 containing the heading "समग्र िशक्षा अिभयान के अन्तगर्त स्थािपत न्याय पंचायत संसाधन के न्द्रों एवं ब्लॉक संसाधन के न्द्रों के संबंध में" is quoted hereunder:- "4- न्याय पंचायत संसाधन के न्द्रों एवं ब्लाक संसाधन के न्द्रों के पुनगर्ठन के संबंध में िनम्नवत िनदेर्श िदये जाते हैं:- .... (3) चयन प्रिक्रया:- िशक्षक साथी के चयन हेतु प्रितिष्ठत न्यूनतम 02 समाचार पत्रों में िवज्ञिप्त का प्रकाशन िकया जायेगा। िवज्ञिप्त में आवेदन हेतु उिल्लिखत िवषय को स्पष्ट िकया जाये। (4) Academic Resource Person (ARP) के चयन हेतु जनपदीय चयन सिमित िनम्नवत होगी:- 1-मुख्य िवकास अिधकारी, अध्यक्ष 2-प्राचायर्, िजला िशक्षा एवं प्रिशक्षण संस्थान सदस्य 3-िजला बेिसक िशक्षा अिधकारी सदस्य-सिचव 4-िजला समन्वयक (प्रिशक्षण) सदस्य 5-विरष्ठ खण्ड िशक्षा अिधकारी सदस्य" 16. A perusal of the Government Order dated 20.10.2019 would reveal that with respect to Academic Resource Person (ARP), a committee has been constituted, which comprises of 5 members and the opposite parties CAPL No. 3875 of 2026 8 not the members. 17. At this stage, Sri Yatindra, as per the instruction received from the client, submits that the representations so preferred by the applicant before the opposite party shall be transmitted to the said committee, which shall decide the said matter. 18. Accordingly, without going further, the contempt application stand disposed of requiring the opposite party in the present contempt petition to transmit the entire papers/ representation so submitted by the applicant by 09.10.2026 and the District Selection Committee, Academic Resource Person (ARP) Chitrakoot through its Chairman, who was already a party in the writ petition as respondent no. 5, being opposite party no. 2 in the contempt application, shall decide the same within a period of 6 weeks. Liberty is accorded to the applicant to again approach this Court as and when the situation arises. 19. The Government Order dated 20.10.2019 is taken on record and marked as Appendix B.
