The present writ petition has been filed for following reliefs:- “A. A writ in the nature of Mandamus commanding upon the respondents especially Respondent No.-2 to 4 restraining Respondent No.-5 from illegally constructing house and other concrete structures over the ancestral house in which the petitioner is residing both being own brother and sister and compelling the petitioner to move out of the house, taking into consideration that Partition Suit being Original (Partition) Suit No. 66/2022 is pending before the Court of Senior Civil Judge-I, Dumka between the petitioner and Respondent No.-5. B. A writ in the nature of Mandamus commanding upon the respondents especially Respondent No.-2 to pass appropriate Order upon the Application/Representation dated 23/05/2025 (Annexure-2) filed by the petitioner taking into consideration that Partition Suit being Original (Partition) Suit No.- 66/2022 is pending before the Court of Senior Civil Judge-I, Dumka between the petitioner and Respondent No.-5 but till date no action has been taken by the respondent authorities to the best of the knowledge of the petitioner. C. A writ in the nature of Mandamus commanding upon the respondents especially Respondent No.-3 to immediately pass appropriate Order upon the Application filed by the petitioner registered as Application No.-273/2025 dated 27/05/2025 (Annexure-3) as till date no action has been taken by the concerned authority upon the same to the best of the knowledge of the petitioner. 2026:JHHC:469 2 W.P.(C) No.7495 of 2025 D. During the pendency of the instant Writ petition Status Quo be maintained by the concerned authorities especially Respondent No.-3 & 4.” 2. It appears that there is partition suit between the petitioner and the private respondent. It is a family dispute and already a partition suit is pending. 3. In view of the above, the present writ petition stands disposed of giving liberty to the parties to work out their remedy in the pending suit. 4.
