1. Petitioner has filed this writ petition seeking following reliefs:
“10.1 That, this Hon'ble Court may kindly be pleased to quash and set aside the impugned order dated 07.01.2026 bearing File No. ESTB-102(2)/498/2025 passed by the Under Secretary, Water Resources Department, Government of Chhattisgarh (Annexure P- 1). 10.2 That in case the sealed cover recommendations of the DPC dated 29.12.2022 are not available or cannot be acted upon due to administrative reasons, this Hon'ble Court may be pleased to direct the Respondents to convene a Fresh/Review Departmental Promotion Committee to assess the Petitioner's suitability for the post of Assistant Engineer (Civil) against the vacancies of the year 2022-2023, ignoring the period of suspension and the pendency of the criminal case, and to grant him all consequential benefits including seniority and arrears from the date his juniors were promoted. 10.3 The Hon'ble Court may kindly please to issue a further direction to the Respondents to complete the aforesaid exercise within a time-bound period as may be fixed by this Hon'ble Court, in view of the imminent retirement of the Petitioner in August 2026.”

Learned counsel for the petitioner submits that petitioner was initially appointed on the post of Sub Engineer (Civil). His name was considered for promotion by the DPC, but considering the fact that on the said date, petitioner was put under suspension, he was not considered for promotion. Thereafter order of promotion has been issued. Subsequent to impugned order (Annexure P-1) suspension of
3 / 3 the petitioner was revoked vide order dated 04.11.2025 and therefore petitioner as of now became eligible for consideration of his promotion.

Learned counsel for the State submits that petitioner has not filed representation before the authority for redressal of grievance as raised in this writ petition.
4. At this stage, learned counsel for the petitioner submits that he may be permitted to submit representation before respondent No.1 and in turn respondent No.1 be directed to consider and take decision on representation to be submitted by petitioner at the earliest within specified time frame.
5. On due consideration of submission of learned counsel for the parties, this writ petition at this stage is disposed of permitting the petitioner to submit comprehensive representation before respondents No. 1 to 3 and in the event petitioner submits such representation, concerned authorities shall consider and decide the same in accordance with law, expeditiously, preferably within a period of 3 months from the date of receipt of representation.
