(b)The action of the 3rd Respondent in issuing proceedings vide Rc. No. 9288/A2/2022 dated 05.09.2023, repatriating the Petitioner to the post of School Assistant (Maths) and posting the Petitioner to Government High School Boys Sathyavedu of Sathyavedu Mandal by relieving the Petitioner from his duties as Assistant Statistical Officer in the office of the ' Respondent on the A.N. of 05.09.2023 as illegal, arbitrary and violative of Articles 14, 21 of the Constitution of India and consequently set aside the same. (c) The action of the 2nd Respondent vide Rc.No.ESE02-28/42/2023-PLG CSE instructing the 3rd Respondent to take necessary disciplinary action against the Petitioner for not reporting to the duty in accordance with the procedure laid down in the APCS (CCA) Rules, 1991and submit action taken report on or before 25.11.2023 without considering the representation submitted by the Petitioner dated 14.09.2023 as illegal, arbitrary and in violation of principles of natural justice and consequently set aside the same.
