Das, ASC CORAM: THE HON'BLE MR. JUSTICE BIRAJA PRASANNA SATAPATHY ORDER 02.02.2026 Order No. 01 1. This matter is taken up through hybrid mode. 2. Though the matter was listed under the heading of Fresh admission, but on the consent of the learned counsel appearing for the Parties, the same was finally disposed of at the stage of Fresh admission. 3. Heard learned counsel appearing for the Parties. 4. Learned counsel appearing for the Petitioner contended that against the adverse CCR communicated to the Petitioner vide letter dtd.07.01.2025 under Annexure-19, Petitioner made a detailed representation before Opp. Party No. 1 under Annexure-20 on 20.02.2025. 5. However, without assigning any reason whatsoever, representation so filed by the Petitioner to expunge the adverse CCR was rejected. It is contended that since no reason has been assigned while rejecting the representation so made by the Petitioner against the adverse CCR, the same is not sustainable in the eye of law. Page 2 of 2. 6. Even though learned Addl. Standing Counsel supported the impugned rejection, but this Court taking into account the fact that against the adverse CCR so communicated on 07.01.2025 under Annexure-19, Petitioner though made a detailed representation on 20.02.2025, but Opp. Party No. 1, as found from the impugned communication, without assigning any reason rejected the same. 7. In view of such illegalities, which is apparent on the face of the order, this Court while quashing the rejection so available under Annexure-21, remits the matter to Opp. Party No. 1 to take a fresh decision on the issue by considering the representation made by the Petitioner under Annexure-20, in accordance with law within a period of six (6) weeks hence from the date of receipt of this order. 8. The writ petition accordingly stands disposed of. (BIRAJA PRASANNA SATAPATHY) Judge Sneha
