Vinoth Kumar, Government Advocate (Criminal side) ORDER The petitioner, who was arrested and remanded to judicial custody on 28.02.2026 for the alleged offences under Sections 332(b), 70, 309(4), 351(3), 64(2)(m) r/w 3(5) of B.N.S in Cr. The case of the prosecution is that on 24.09.2014 at about 7.45 p.m., when the defacto complainant was sleeping at her home, the accused persons trespassed into her house and threatened her and committed rape against her will and thereafter, snatched her Thali weighing ½ sovereign and hence the case. 3. The learned counsel for the petitioner would submit that non-bailable warrant was issued on 03.02.2026 and the petitioner was remanded into judicial custody on 28.02.2026 on execution of non-bailable warrant. He would further submit that case is at the stage of trial and the petitioner is ready and willing to co-operate for trial and hence prayed to enlarge the petitioner on bail. 4. The learned Government Advocate (Criminal side) appearing for the respondent police strongly opposed the bail application on the ground that there are 19 previous cases pending against the petitioner and the present FIR is of the year 2014 and the petitioner became absent on crucial stage, thereby there was a huge delay in proceeding with the case hence if the petitioner is enlarged on bail, 5. Taking into consideration of the submissions made by the learned Government Advocate, upon the fact that there are 19 previous cases pending against the petitioner and upon the tactics played by the petitioner by absenting himself at crucial stage, this Court is of the firm view that if the petitioner is enlarged on bail, there will be further delay in proceeding with the trial and therefore, this Court is not inclined to enlarge the petitioner on bail. 7.
