(Oral) Petitioner has challenged the order dated 19.06.2026 passed by respondent No.2-Director General, School Education, Uttarakhand, whereby, attachment of the Assistant Teachers/Lecturers, has been cancelled as well as the order dated 23.06.2026 passed by respondent No.3-Chief Education Officer, Nainital, whereby, in compliance of order passed by Director General, School Education, attachment of petitioner has been cancelled and petitioner was directed to be relieved. 2. Learned counsel for petitioner submits that petitioner has now been relieved to her parent school - Government Upper Primary School, Deena, Block Haldwani, District Nainital, where she was posted, i.e. pursuant to aforesaid impugned order, after cancelling her attachment at Government Upper Primary School, Kathghariya, Block Haldwani, District Nainital. 3. He further submits that petitioner was attached due to her adverse family condition as both her children are intellectually challenged to the extent of 80% and 52% respectively. Her daughter also suffers from fits UKHC010146142026 2026:UHC:7391 2 15 per day. The said condition is still in existence and yet the attachment of the petitioner has been cancelled by the respondent-authority. 4. Learned counsel for petitioner contends that petitioner has again submitted an application dated 12.08.2026 to respondent No.2-Director General, School Education, Uttarakhand, (Annexure No.10 to the writ petition), requesting to attach her again in the same school i.e. Government Upper Primary School, Kathghariya, Block Haldwani, District Nainital, as no one has joined in her place, and further the situation of her children is still same, as it was earlier at the time when she was attached. 5. He further contends that if the respondent No.2-Director General, School Education, Uttarakhand, is directed to take a decision on the said application of petitioner in a time bound manner, the ends of the justice would be met. 6. Learned State Counsel has no objection, if such a direction is issued to respondent No.2. 7. Accordingly, the writ petition is disposed of. Respondent No.2-Director General, School Education, Uttarakhand, is directed to sympathetically consider and take a decision on the application of petitioner dated 12.08.2026 (Annexure No.10 to the writ petition), considering the peculiar facts and circumstances of the petitioner, within a period of two months from today. 8.
