IN THE HIGH COURT OF ORISSA AT CUTTACK CRLMP No. 217 of 2026 Sagar Muduli …. Petitioner Mr. S.K. Mishra, Advocate -versus- Sub-Divisional Magistrate, Puri …. Opposite Party Mr. Sarathi Jyoti Mohanty, Additional Standing Counsel CORAM: THE HON’BLE MISS JUSTICE SAVITRI RATHO Order No. ORDER 23.02.2026 01. (Through hybrid mode) 1. This CRLMP has been filed for a direction to the Opposite Party to dispose of Crl. Misc. Case No.796 of 2025 expeditiously within a stipulated date. 2. Mr. S.K. Mishra, learned counsel for the Petitioner submits that Crl. Misc. Case No.796 of 2025 has been filed in August, 2025 under Section 152 of the BNSS. 3. It is stated in paragraph-6 of the CRLMP that although the case has been registered, no further action has been taken as per law and the matter is pending without any progress. But, learned counsel for the Petitioner submits that the petition is pending for hearing. 4. Since the order-sheet in Crl. Misc. Case is not filed, it is not possible to ascertain what the stage the Crl. Misc. Case is at and whether the matter is lingering unnecessarily. 5. Hence, the CRLMP is disposed of granting liberty to the Petitioner to approach the learned Sub-Divisional Magistrate, Puri with an application for early disposal of the Crl. Misc. Case. 6. It is made clear that this Court has not examined the merits or maintainability of the case of the Petitioner before the learned Sub-Divisional Magistrate, Puri and the application for early hearing will be considered on its own merit.
