1 2026:CGHC:20617 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR CONT No. 619 of 2026 Smt. Nandni Ghritlahre Wd/o- Dilip Kumar Ghritlahre Aged About 35 Years Presently Working As Assistant Teacher (L.B.) At Government Primary School, Chhatauna (Mandir Hasaud), Block Arang, District Raipur (C.G.) ... Petitioner versus Rituraj Raghuvanshi Presently Posted As Director, Directorate of Public Instruction, Indrawati Bhawan, Atal Nagar Nawa Raipur, District Raipur (C.G.) ... Respondent (Cause-title taken from Case Information System) For Petitioner : Mr. Govind Prasad Dewangan, Advocate Hon’ble Shri Amitendra Kishore Prasad, Judge Order on Board 04.05.2026 1. By filing the present contempt petition, the petitioner assails the willful non-compliance of the order dated 07.01.2026 passed by this Court in WPS No. 36/2026. The petitioner has prayed for following relief :- “It is, therefore, prayed that this Hon'ble Court may kindly be pleased to initiate contempt proceeding against the contemnor and punish YOGESH TIWARI Digitally signed by YOGESH TIWARI Date: 2026.05.04 17:42:56 +0530 2 the non-applicant/contemnor for the non compliance/disobeying of Hon'ble Court order dated 07.01.2026 passed in W.P. (S) No. 36/2026 Annexure-C/1, in the interest of justice.” 2. Learned counsel for the petitioner submits that despite a specific direction issued by this Court vide order dated 07.01.2026 in WPS No. 36/2026, directing the respondents to consider and decide the petitioner’s representation within a period of two months, the said direction has not been complied with till date. It is submitted that the petitioner duly submitted her representation within time, however, the same is still pending without any justifiable reason. It is further submitted that the inaction on the part of the respondents is deliberate and amounts to willful disobedience of the order passed by this Court. Such conduct, it is argued, undermines the authority of this Court and renders the respondents liable to be proceeded against under the provisions of the Contempt of Courts Act. He, therefore, prays that appropriate contempt proceedings be initiated against the respondents for non-compliance of the order dated 07.01.2026 and necessary directions be issued to ensure prompt compliance of the same. 3. From perusal of the impugned order dated 07.01.2026, it transpires that this Court, considering the limited nature of grievance of the petitioner, had issued a specific and time-bound direction to respondent No.2 to decide the pending representation 3 of the petitioner expeditiously, preferably within a period of two months from the date of receipt of the copy of the order. The direction was thus clear, unambiguous and required prompt compliance within the stipulated time. 4. Considering the matter in its entirety, the petitioner is directed to submit a fresh representation before the competent authority within a period of two weeks from the date of receipt of a certified copy of this order. Upon such representation being filed, the competent authority shall consider and decide the same strictly in accordance with law within a further period of four weeks from the date of its submission. 5. With the aforesaid observations and directions, the instant contempt petition stands disposed of. 6. There shall be no order as to costs. Sd/- (Amitendra Kishore Prasad) Judge Yogesh
