Learned counsel for the petitioner submit that, although after adjudicating the dispute, directions have been given by the Sub Divisional Magistrate, Deoli, Tonk to remove the unauthorized encroachment, yet only on account of the fact that police assistance is not being provided, the encroachment in question has not been removed. Learned counsel for the petitioner submits that petitioner would be satisfied, in case, liberty is granted to the petitioner to submit a representation before the District Collector, Tonk with regard to his grievance, who may be directed to decide the representation strictly in accordance with law. 3. In view of the limited prayer made by counsel for petitioner, this Court deems it just and proper to grant liberty to the petitioner to submit a detailed representation along with all documents before the District Collector, Tonk, who shall consider the representation strictly in accordance with law and shall pass an appropriate speaking order after following the due process of law within a period of 15 days from the date of receipt of representation. 4. With aforesaid observations, instant writ petition stands disposed of. 5. It is made clear that this Court has not expressed any opinion on merits of the case. 6.
