1. The appeal and the connected application were
disposed of by us by a judgment and order dated July 10, 2025. The application for recall of the said order being CAN 2 of 2025, filed by the Union of India was dismissed by our order dated January 21, 2026. Paragraph 18 of that order reads as follows :
“Since we have dismissed the recalling application, the proforma respondent shall permit the Special Officer to take actual physical possession of the concerned plant, equipment and machinery of the appellants as per the inventory list in implementation of our
order dated July 10, 2025. The proforma respondent shall extend all co- operation in that regard. All other directions in our order dated July 10, 2025 shall remain operative.”
2. Learned advocate for the appellants and learned Special Officer today tell us that the learned Special
2 Officer has taken possession of the concerned plant, equipment and machinery ownership of which is claimed by the appellants. Learned Special Officer has also handed over such plant, equipment and machinery to the appellants herein in terms of our direction contained in the order dated July 10, 2025. The Special Officer has filed a final report today which be kept with the records.
3. We reiterate that till an award is passed in favour of the appellants, if at all, or without leave of the arbitral Tribunal, the appellants shall not deal with or dispose of the plant, machinery and equipment in question. The appellants may however, utilize the same in the usual course of business.
4. The appellants shall pay to learned Special Officer a final remuneration of Rs.30,000/- within two weeks from date (May 1, 2026).
5. Upon such payment, learned Special Officer shall stand discharged. The matter stands closed in so far as this Court is concerned.
