In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Jiaganj Police Station Case No. 31 of 2026 dated 25.01.2026 under Sections 126(2)/115(2)/109/3(5) of the BNS 2023. And In the matter of: Akash Biswas @ Papai Biswas & another. …. Petitioners
Mr. Navanil De Ms. Monami Mukherjee …for the petitioners
Mr. Debabrata Chatterjee Mr. Sufi Kamal
…for the State Mr. Rudraksha Chattopadhyay Mr. Karunamoyee Samanta
…for the de facto
Learned counsel appearing on behalf of the petitioners submits that there was a free fight between friends. Both sides received injuries. However, none was grievous in nature.
Learned counsel appearing on behalf of the de facto complainant strongly opposes the prayer for anticipatory bail.
Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the injury report, which shows infliction of a cut injury on a vital part of the body like the head. The injury has been recorded as grievous in injury report. He also refers to the FIR and the statements of witnesses.
Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail is rejected.
