The petitioner is an accused in the case registered for the offence punishable under Sections 331(4) and 305(a) of the Bharatiya Nyaya Sanhita (BNS), 2023. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged. The petitioner has not been named in the F.I.R. During investigation, the name of the petitioner surfaced on the basis of the alleged confessional statement of the named co-accused, Manish Kumar Sharma, however, there is no recovery of any stolen article from the possession of the petitioner. It is further submitted that a similarly situated co-accused, Shambhu Gope @ Sambhu Gope, has already been granted regular bail by a Bench of this Court vide order dated 16th March, 2026 passed in B.A. No.2025 of 2026. The petitioner has no criminal antecedent, as has been stated in paragraph no.8 of the present bail 2026:JHHC:7798 2 application. The petitioner is in judicial custody in connection with the present case since 18th January, 2026. Hence, he may be given the privilege of regular bail. 3. Learned A.P.P. opposes the petitioner’s prayer for regular bail. 4. Having heard learned counsel for the parties and considering the materials available on record, the petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Deoghar in connection with Deoghar (Town) P.S.
