CORAM: JUSTICE V. NARASINGH
Order No.
ORDER 21.04.2026 I.A. No.410 of 2026
06.
1. This is an interim application, seeking the following relief:-
“Under the above circumstances it is humbly prayed by the petitioner that this Hon'ble court may graciously be pleased to allow this interim application by modifying to the extent of correction of “10% of the cheque amount of Rs. 25,00,000/- in terms of Section 148A of the N.I. Act" in Para-10 of the order dated 31.03.2026 which may be corrected as “10% of the compensation amount of Rs. 50,00,000/- in terms of Section 148A of the N.I. Act" on any such terms and condition.”
2.
Learned counsel for the Petitioner opposes such submission. p. 2
3. The direction passed in Paragarph-10 of the
judgment is culled out hereunder for convenience of reference:-
“10. Taking into account the submission of the
learned counsel regarding health condition of the Petitioner and financial constraints, this Court is of the considered view that directing the Petitioner to deposit 10% of the cheque amount of Rs.25,00,000/- in terms of Section 148A of the N.I. Act within a period of two weeks would sub serve the ends of justice. The amount, if deposited, shall be released in favour of the Opposite Party No.2, which shall abide by the outcome of the appeal.”
4. On a bare perusal of the tenor of the order, it is clear that what this Court meant was that 10% of the cheque amount not compensation amount.
5. Considering the submissions made at the Bar, this Court is not persuaded to hold that the prayer as made in the I.A. can be entertained.
6. Accordingly, the I.A. stands disposed of.
