Case No. 76 of 2025, registered for the offence under Section 331(3), 305, 112(2) and 317(2) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Bermo at Tenughat. 2. Learned counsel appearing for the petitioner submits that the petitioner was not named in the FIR and on the basis of CCTV footage, one Raju Ansari was arrested and that Raju Ansari has taken the name of this petitioner and thereafter the petitioner has been arrested and from the house of this petitioner, certain articles have been recovered. He next submits that the petitioner is in judicial custody since 13.09.2025. He further submits that in similar circumstance, from another person, certain articles have been recovered, has already been granted regular bail in B.A. No. 11102 of 2025 by the co-ordinate bench. 3. Learned A.P.P. appearing for the State has opposed the prayer and submits that from the possession of this petitioner, recovery [2026:JHHC:910] -2- has been made. 4. Considering that the similarly situated co-accused, from whose possession also, the recovery has been made, has already been granted regular bail in B.A. No. 11102 of 2025 by the co-ordinate bench and further the petitioner is in judicial custody since 13.09.2025, I am inclined to release the petitioner, on regular bail. 5. Accordingly, the petitioner, named above, is directed to be released on regular bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bermo at Tenughat, in connection with Gomia P.S.
