The petitioner is seeking regular bail in connection with Koderma (Mahila) P.S. Case No.11 of 2025 for the alleged offences registered under Sections 79, 85, 109(1), 115(2), 117(2), 351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Sections 3/4 of Dowry Prohibition Act, pending in the Court of learned S.D.J.M., Koderma. 3. Learned counsel appearing for the petitioner submits that the petitioner happened to be husband of the informant. He further submits that the allegation of beating is of 31.10.2023 2026:JHHC:1133 --2-- B.A. No. 11358 of 2025 and 01.11.2023 wherein the FIR has been lodged on 05.05.2025. He then submits that the petitioner has filed a petition under Section 9 of Hindu Marriage Act for restitution of conjugal rights on 19.09.2024 and thereafter the present FIR has been lodged by the wife. He next submits that the petitioner is in custody since 09.10.2025. 4. Learned counsel appearing for the State submits that petitioner happened to be husband. 5. Considering that the allegation of beating is of 31.10.2023 and 01.11.2023 and the FIR has been lodged on 05.05.2025 and the petitioner has filed the petition under Section 9 of Hindu Marriage Act for restitution of conjugal rights and thereafter the present case has been lodged and the petitioner is in custody since 09.10.2025, I am inclined to grant regular bail to the petitioner. 6. Accordingly, the petitioner, above named, shall be released on regular bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Koderma in connection with Koderma (Mahila) P.S.
