1. The petitioners has preferred this bail application under Section 483 of BNSS in FIR No.23/2025 registered at Police Station Nawalgarh, District Jhunjhunu for offences under Sections 189(2), 126(2), 115(2), 333, 140(4), 109(1), 324(4) and 307 of BNS, 2023.
2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioners submit that the petitioners have falsely been implicated in this case. He submits that similarly situated co-accused Sanjay has been granted the
[2026:RJ-JP:26458] (2 of 3) [CRLMB-8759/2026] benefit of bail by a Coordinate Bench of this Court vide order dated 15.10.2025. It is further submitted that the other co- accused Pradeep, Bunty, Vikas, Ashish and Anurag have also been enlarged on bail by a Coordinate Bench of this Court vide order dated 12.03.2025. Learned counsel further submits that though there is an allegation that the petitioner Shivansh caused injuries to the injured-Dharmendra but the injuries attributed to him are simple in nature. Petitioners are behind the bars since 16.05.2026 though seven cases against petitioner- Shiwansu Dhaka and three cases against petitioner- Amit are reported against them, however, in all cases they are on bail. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and on the ground of parity with other co-accused, the bail application deserves to be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Shiwansu Dhaka S/o Dhalchand and Amit S/o Mohar Singh, be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with
[2026:RJ-JP:26458] (3 of 3) [CRLMB-8759/2026] the stipulation that each of them shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
