This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS, 2023’) has been NIKITA JAIN Digitally signed by NIKITA JAIN Date: 2026.05.04 10:46:54 +0530 2 filed by the applicant, who is apprehending his arrest in connection with Crime No.278/2026 registered at Police Station – Janjgir, District – Janjgir-Cahmpa (C.G.) for the offence punishable under Section 69 of Bharatiya Nyaya Sanhita, 2023. 2. The case of the prosecution, in brief, is that the complainant lodged a report at Police Station Janjgir, District Janjgir Champa alleging that the applicant on the pretext of marriage had committed rape upon the victim on several occasions. It is alleged further that on 11.12.2025, the accused came to police station and prevented her from filing a complaint and asked for 10 days to marry her. Subsequently, the accused refused to marry her. The victim filed a written complaint on 15.04.2026. Based on the said complaint, the police registered an offence punishable under Section 69 of Bharatiya Nyaya Sanhita, 2023. 3. Learned counsel for the applicant submits that the present applicant is an innocent person and has been falsely implicated in the present case. He submits further that the victim is a major girl, who had a love relationship with the applicant. It is further argued that the victim is found to be a married lady and the said fact was not disclosed by her to the applicant and prays for grant of regular bail to the present applicant. 4. Learned counsel for the objector vehemently opposes the bail application and submits that the accused has acted with dishonest intention from the very inception, and such case involves false promise of marriage leading to sexual exploitation. He submits further that the victim already shown her profile where she has admitted that she is a 3 married lady. 5. On the other hand, learned counsel State counsel opposes the bail application of the present applicant and submits that the present applicant on the pretext of marriage established physical relationship with the victim and thereafter denied, therefore, he is not entitled for grant of regular bail. 6. I have heard learned counsel for the parties and perused all of the documents taken on record. 7. Considering the facts and circumstance of the case, nature and gravity of offence and from perusal of the statement of the victim, it appears that the victim is a major girl, who had a love relationship with the applicant, but after some time their relationship could not be materialized, then she filed aforesaid case against the present applicant, the trial is likely to take sometime for its conclusion, therefore, I am of the opinion that the applicant is entitled to be released on bail in this case. 8. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Vikram Singh Anant, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. 4 (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of his adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
