JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court seeking the following prayer: "To quash the impugned FIR, complaint (Annexure-'A' and 'B') and the entire proceedings in C.C.No.31529 of 2025 pending before the Hon'ble XLV Additional Chief Judicial Magistrate at Bangalore (Annexure-C and D) arisen out of Cr.No.159/2024 before the Central CEN Crime Police Station i.e., Respondent No.1 for offences punishable under Section 66 of the Information Technology Act, 2000, in the interest of justice and equity." - 3 - HC-KAR NC: 2026:KHC:10957 CRL.P No. 14171 of 2025 2. Heard Sri. Ankur Tripathi, learned counsel appearing for the petitioner, Sri. K Nageshwarappa, learned HCGP appearing for respondent No.1, Sri. Pawan Kumar M.N., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed joint affidavit. The Joint affidavit reads as follows: "JOINT AFFIDAVIT We, Mr. Subham Jobanputra, aged about 30 years, S/o Manoj Kumar Jobanputra, R/at B-520, 5th Floor, RR Residency, Hosapalya Main Road, Bangalore-560 048 the petitioner and Mr.Shashankagowda N P Son of Mr.Papanna, Aged about 28 years, Address at: Lemon Peak Marketing Service, No.14/14, 2nd Unity Building, Bengaluru 560 002 hereby solemnly affirm and state on oath as follows: 1. That we state that we are the petitioner and respondent No.2 respectively in the above Criminal Petition. We are well acquainted with the facts and circumstances of the case and hence competent to swear to this Joint Affidavit. 2. I, the Respondent No.2, state that I had lodged a complaint on 07.03.2024, pursuant to which an FIR came to be registered in Crime No.159/2024 before the - 4 - HC-KAR NC: 2026:KHC:10957 CRL.P No. 14171 of 2025 Central CEN Crime Police Station, Bengaluru, for the offences punishable under Sections 66 and 66D of the Information Technology Act, 2000 and Section 420 of the Indian Penal Code against the petitioner herein. I further state that the respondent No.1 Police, after investigation, have filed a charge sheet in C.C.No.31529/2025 on the file of the Hon'ble XLV Additional Chief Metropolitan Magistrate, Bengaluru, only for the offence punishable under Section 66 of the Information Technology Act,2000. 3. That the petitioner and respondent No.2 state that all disputes and differences arising out of the aforesaid complaint have been amicably settled between them out of free will, without any force, coercion or undue influence. The respondent No.2 has voluntarily agreed to resolve the matter and forego all past grievances arising out of the subject transaction. 4. I, the respondent No.2, state that I do not wish to pursue the complaint or the criminal proceedings pending against the petitioner in C.C.No.31529/2025 and I have no objection whatsoever for quashing of the said proceedings by this Hon'ble Court in exercise of its inherent powers. Wherefore, we humbly pray before this Hon'ble Court to kindly compound the offence and quash the entire proceedings in C.C.No.31529/2025 (Annexure-C and D) Hon'ble XLV Additional Chief Judicial Magistrate at Bangalore arisen out of Cr.No.159/2024 before the Central CEN Crime Police Station i.e. Respondent No.1 for offences punishable under Section 66 of the Information Technology Act,2000, in the interest of justice and equity." 4. In the light of affidavit for compounding offence being filed and offences not being against the State, I deem it appropriate to accept the compounding affidavit - 5 - HC-KAR NC: 2026:KHC:10957 CRL.P No. 14171 of 2025 and terminate the proceedings against this petitioner in the subject petition. 5. For the aforesaid reasons, the following: ORDER i. *Criminal Petition is disposed. ii. Proceedings in C.C.No.31529/2025 on the file of XLV Additional Chief Judicial Magistrate, Bangalore arisen out of Cr.No.159/2024 before the Central CEN Crime Police Station, stands quashed qua the petitioner.
