After disposal of the petition, the present application has been filed by the applicant/petitioner, praying for the following reliefs:- “a. Modify the order dated 27.04.2026 passed in Criminal Writ Petition No.25 of 2026 to the extent that the applicant be granted liberty to file a fresh petition under Section 528BnSS or Criminal Writ Petition under Article 226 of the Constitution of India on the same cause of action but in changed circumstances thereof; b. Pass any other order(s) as this Hon’ble Court may deem fit and property in the interest of justice.” 2. The petition was disposed of by us on 27.04.2026, by passing the following order:- 1Whether the reporters of the local papers may be allowed to see the Judgment? Yes -2- “Learned counsel for the petitioner, under instructions, seeks permission to withdraw the present petition with liberty to raise the contentions, which have been raised herein, at the stage of framing of charges. 2. Permission granted. Accordingly, present petition is dismissed as withdrawn with liberty reserved, as prayed for. 3. Pending miscellaneous application(s), if any, shall also stand disposed of.” 3. Having heard the learned counsel for the applicant/petitioner and having perused the contents of the application, we are of the considered view that there is no occasion for us to modify the order dated 27.04.2026, in terms of the prayer made in the application because in case the applicant/petitioner has any remedy available in law, then he can always avail the same in accordance with law.
