Considering the fact that the matter which has been disputed in this petition is pending for consideration before the Arbitrator as respondent No.2/NHAI has approached before the Arbitrator by filing an reference, in which, the petitioners are also made a party, however, the petitioners are not appearing in the said proceedings, therefore, same cannot be decided, as such, the dispute which the petitioners is raising in this petition can also be adjudicated by the concerned Authority/Arbitrator as per the statutory provision under Section 3G(5) of the National Highways Act, 1956, hence, without entering into the dispute as raised by the petitioners in this petition, the instant petition stands disposed of directing the petitioners to appear before the concerned Arbitrator and in-turn the concerned Arbitrator is also directed to consider and decide the matter of the petitioners in accordance with relevant rules/law, after giving due
