These instant bail applications have been filed against the orders of the learned Trial Court dated 01.04.2026, 27.02.2026 and 10.04.2026 on behalf of the accused-petitioners under Section 483 of BNSS in connection with FIR No. 38/2023 registered at Police Station Special Police Station (SOG), District ATS and SOG for the offence(s) punishable under Sections 419, 420, 467, 468 & 120-B of IPC and Sections 3 & 10 of Rajasthan Public Examination Act, 2022. 2. Learned counsel for the accused-petitioners submit that the accused-petitioners have been falsely implicated in this case; that the charge-sheet has been filed. They also submit that the accused-petitioners are in custody since long and co-accused persons have already been enlarged on bail; conclusion of trial will take its own time, so no fruitful purpose would be served by keeping the accused-petitioners behind the bars and, therefore, [2026:RJ-JP:26433] (3 of 4) [CRLMB-5544/2026] pray that the accused-petitioners may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor vehemently opposes the submissions advanced by learned counsel for the accused- petitioners hereinabove and submits that one another criminal case is registered against the accused-petitioner, Vijay Pal S/o Jagdish Chandra, therefore, the accused-petitioners may not be granted the benefit of bail under Section 483 BNSS. 4. Heard and considered the submissions made at the Bar and perused the material available on record, considering the overall facts and circumstances of the case and the arguments put forth by learned counsel for both the parties; that the accused- petitioners namely, Vijay Pal S/o Jagdish Chandra, Mahipal Vishnoi S/o Ramrakh Ram Vishnoi, Ashok Kumar Vishnoi S/o Hanumanaram Vishnoi & Sunil Bishnoi S/o Shri Kishanlal are in custody since 13.03.2026, 17.02.2026, 09.03.2026 & 29.03.2026; that similarly situated co-accused persons namely Vimla Vishnoi, Rajendra Kumar, Ashok Kumar S/o Mangilal, Satayprakash, Anil Kumar Meena, Surat Ram Meena, Dinesh Kumar S/o Babulal, Dinesh Kumar S/o Aasuram Vishnoi, Sampat Lal & Prince have already been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 03.01.2025, 19.02.2024, 06.11.2024, 24.03.2026 & 30.06.2026 in S.B. Criminal Miscellaneous Bail Application Nos. 16200/2024, 637/2024, 1949/2024, 11789/2024, 11792/2024, 1021/2026, 1672/2026, 1673/2026 & 8835/2026; that the trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case, deems it just and proper to enlarge the accused-petitioners on bail. Therefore, these instant bail applications under Section 483 BNSS are accordingly, allowed and the accused-petitioners (1) Vijay Pal S/o Jagdish Chandra, (2) Mahipal Vishnoi S/o Ramrakh Ram Vishnoi, (3) Ashok Kumar Vishnoi S/o Hanumanaram Vishnoi & (4) Sunil Bishnoi S/o Shri Kishanlal are ordered to be released on bail, provided each of them furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the Trial Court, with the stipulation that they shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 6. It is made clear that the accused-petitioners shall not involve themselves in any offence(s) during currency of the bail. 7. In case of any breach of the aforementioned condition, the learned Public Prosecutor shall be free to move the application against the accused-petitioners for cancellation of the bail before the concerned Court. 8. The observation made hereinabove is only for decision of these instant bail applications and would not have any impact on the trial of the case in any manner. 9.
