W.P.No.9691 of 2026 Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondents to reinstate the petitioner in service with continuity of service and all other attendant benefits and to pay the arrears of the back wages, pursuant to the order of the learned Special Joint Commissioner of Labour, Chennai in Approval Petition No.51 of 2022 dated 27.12.2023. “To direct the respondents to reinstate the petitioner in service with continuity of service and all other attendant benefits and to pay the arrears of the back wages, pursuant to the order of the learned Special Joint Commissioner of Labour, Chennai in Approval Petition No.51 of 2022 dated

2. The petitioner joined in the respondent corporation as a Driver in the year 1995. On 27.04.2021, the respondent issued a charge memo stating that the petitioner has committed an accident and dashed against the two-wheeler and due to the alleged accident, the pillion rider in the two-wheeler had died. The respondent corporation has passed a final order dated 02.03.2022, dismissing the petitioner from service and filed an approval petition in A.P.No.51 of 2022, before the Special Joint Commissioner of Labour, Chennai. 3. The Commissioner has passed an order dated 14.03.2025 refusing to grant approval for the order of dismissal. Thereafter, the petitioner sent a representation dated 23.05.2025 requesting the 3rd respondent to reinstate him into service with continuity of service and all other attendant benefits. However, the same was not considered. Therefore, the petitioner is before this Court. 4.
Considering the facts and circumstances of the case and without traversing the merits of the case, a direction is issued to the 3/6 https://www.mhc.tn.gov.in/judis
W.P.No.9691 of 2026 respondents to consider the petitioner’s representation and pass order on merits and in accordance with law within a period of 4 weeks from the date of receipt of a copy of this order. 5. With the above direction, this writ petition is disposed of. No costs. 11.03.2026
