Subbareddy Street, Teachers Colony, Madanapalle Town, Chittoor District pin Code 517325 2 ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of mandamus, declaring the action of the respondents 3 to 9 in not taking proper action against the 10th respondent as he obtained government job of Sub Inspector of Police by submitting false Caste Certificate basing on the representation dated 20.9.2023 submitted by the Petitioner in the interest of public as illegal, arbitrary and contrary to law and for consequently directing the respondents 3 to 9 to take immediately and proper action against the respondent No. 10 basing on the representation submitted by the petitioner dated 20.9.2023 forthwith and to pass necessary order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case in the interest of justice and to pass IA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents 3 to 9 to take appropriate action against the representation submitted by the petitioner dated 20.9.2023 pending disposal of the above WP and to pass Counsel for the Petitioner: A SREEDHAR Counsel for the Respondents: GP FOR SERVICES I Counsel for the Respondents:J UGRANARASIMHA The Court made the following order: 3 O R D E R 1) The Writ Petition is filed for the following relief: “…. to issue a writ, order or direction more particularly one in the nature of writ of mandamus, declaring the action of the respondents 3 to 9 in not taking proper action against the 10th respondent as he obtained government job of Sub Inspector of Police by submitting false Caste Certificate basing on the representation dated 20.9.2023 submitted by the Petitioner in the interest of public as illegal, arbitrary and contrary to law and for consequently directing the respondents 3 to 9 to take immediate and proper action against the respondent No.10 basing on the representation submitted by the petitioner dated 20.9.2023 forthwith and to pass necessary order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case in the interest of justice and to pass……” 2) It seems there are certain disputes regarding family affairs of the Petitioner with his wife and the 10th Respondent seems to have interfered, which lead to the filing of a complaint before the authorities against the 10th Respondent on 20.09.2023. Resultantly, the Writ Petition filed against the inaction of the Respondents not initiating action pursuant to his complaint. 3) Learned Counsel for the Petitioner brought to the notice of this Court that on 06.08.2025 an “Endorsement” was issued by the Revenue Divisional Officer, Kadapa Sub Division that an enquiry was initiated, however, in view of the pendency of the Writ Petition, the Official Respondents are not proceeding further. 4 4) A query was raised, by this Court, with regard to maintainability of the Writ Petition, as the same is not a Public Interest Litigation, the learned Counsel made a request that as the authorities have commenced enquiry into the matter pursuant to the complaint, he is not seeking any relief against the 10th Respondent, for the present. Otherwise, prays to direct the authorities concerned to proceed further and conclude such enquiry, which was already initiated as per endorsement dated 06.08.2025. 5) This Court is not inclined to give any positive direction however, it is always open for the Official Respondents to proceed further, in accordance with law, in respect of the complaint received against the 10th Respondent as per the endorsement, dated 06.08.2025. 6) With the above observation, the Writ Petition is closed. 7) No order as to costs.
