On the allegation that respondent no.3 is putting up construction in violation of building bye-laws and the sanctioned plan, the present writ petition is filed. 2. Learned counsel for respondent no.2-City Municipal Council, upon instructions submits that, upon inspection it has been found that respondent no.3 has indeed put up construction in violation of building bye-laws and sanctioned plan and action has been initiated against respondent no.3 in the manner known to law. - 3 - HC-KAR NC: 2026:KHC:16867 WP No. 21314 of 2025 3. Learned counsel for respondent no.3 submits that, petitioner is also guilty of putting up construction in violation of buildings bye-laws and the sanctioned plan. 4. In the light of aforementioned submissions of learned counsel for respondent nos.2 and 3, writ petition is disposed of with a direction to respondent no.2 to take the action initiated against respondent no.3 to its logical end in accordance with law within a period of three months from today. Respondent no.2 is further directed to initiate appropriate action against the petitioner also in accordance with law, if it is found that his construction is in violation of building bye-laws and the sanctioned plan.
