Mrs. Prabha Naithani, learned counsel for the applicants. 2. Mr. Tumul Nainwal, learned AGA for the State. 3. Mr. Gaurav Panwar, learned counsel for respondent no.2/complainant. 4. Instant petition is moved by the applicants-Anchit Rastogi, Sanjay Rastogi and Meena Rastogi alongwith compounding application with the affidavit of respondent no.2/complainant Umang Rastogi for quashing the proceeding of Criminal Case No.3513 of 2025 arising out of Case Crime No.325 of 2023 State vs. Anchit Rastogi and others pending in the court of learned Chief Judicial Magistrate, Dehradun wherein all the applicants have been summoned to face the trial for the offences punishable under Section 498-A, 323 and 504 of IPC. 5. The applicant no.1 and respondent no.2 are present in the Court and are identified by their counsel. 6. The brief facts of the case are that the applicant no.1 married with respondent no.2 in the year 2022 and both of them lived together about for three months and
thereafter due to some dispute they are living separately. Now they have decided to settle their all matrimonial disputes to get divorce by way of mutual consent and towards the permanent alimony a total amount of Rs.12.00 lacs. have also been decided out of which Rs.04.00 lacs. have already been paid and Rs.04.00 lacs. is being paid today to respondent no.2 through a bank draft and the remaining amount of Rs.04.00 lacs., the applicant no.1, shall pay on the second motion before the family court. It is further submitted that the divorce petition is already filed for seeking divorce by way of mutual consent and the first motion has already been completed and for second motion 17.08.2026 is fixed. 7. The respondent/wife is present and submits that as per their amicable settlement the applicant no.1 also undertakes to hand over the jewellery, the inventory of the same is already prepared which the applicant admit and submits that he shall hand over the same on the date of second motion. 8. On the other hand Mr.
Tumul Nainwal, learned AGA for the State submits that since the dispute appears to be matrimonial one and now they have resolved their disputes to get divorce by mutual consent and amount towards permanent alimony has already been determined and some part of which has been paid, therefore, there is no useful purpose to continue with the proceeding. 9. After hearing the
submissions of
learned counsel for the parties and taking into consideration that the parties have resolved their matrimonial disputes to get
divorce by mutual consent and the part payment towards alimony is already paid, this Court is of the view that the present C528 petition as well as the compounding applications deserve to be allowed.
10. Accordingly, the C528 petition as well as the compounding application are allowed the entire proceeding of Criminal Case No.3513 of 2025 arising out of Case Crime No.325 of 2023 State vs. Anchit Rastogi and others pending in the court of learned Chief Judicial Magistrate, Dehradun is hereby quashed.
