JUSTICE LALITHA KANNEGANTI - 3 - HC-KAR NC: 2026:KHC:14050 WP No. 7703 of 2026 ORAL ORDER The present writ petition is filed seeking the following prayer: PRAYER WHEREFORE, it is respectfully prayed that the Hon'ble court may kindly be to issue writ of CERTIORARI or any other order or direction in the nature of writ;- a) Quash the E-auction notice dated 3/2/2026 issued by the respondent No-1/Finance vide ANNEXEURE- G, and, b) To direct the respondent No-1/Finance to grant reasonable four months time for payment of entire loan and close the loan account, and Cost and other reliefs which deems fit to grant under the circumstances of the case, in the interest of justice and equity. 2.In the light of the Judgment passed by the Hon’ble Apex Court in Civil Appeal Nos.257-259/2022 between Phoenix ARC Private Limited Vs. Vishwa Bharathi Vidya Mandir and others arising out of WP.Nos.35564-35566/2015 dated 27.03.2018, the present writ petition is not maintainable against the M/s.
