Heard Mr. Himanshu Pandey, learned counsel for the petitioner. Also heard Mr. N. K. Jaiswal, Dy. Govt. Advocate for the Respondent/ State. 2. The present writ petition has been filed by the petitioner seeking following relief:- 10.1. Direct the respondent authorities to conduct preliminary inquiry before registration of FIR pursuant to SAGRIKA AGRAWAL Digitally signed by SAGRIKA AGRAWAL Date: 2026.05.04 10:40:27 +0530 2 same set of facts as alleged in the complaint dated 27/03/2026 and 30/03/2026 submitted by respondent no. 2 before the Police Station, Tikrapara, Raipur. 10.2. Direct the respondent no 1 to register a FIR against the respondent no. 2. 3. Learned counsel for the petitioner submits that the grievance of the petitioner with respect to Paragraph 10.1 has now become infructuous as the complainant herself made an application that she does not want any inquiry on her complaint and therefore he is not pressing the relief claimed in Paragraph 10.1 of the petition and he wishes to press the present petition only with respect to the relief sought in Paragraph 10.2. He further submits that despite several complaints having been made, no action has been taken by the State respondents. 4. We have perused the prayer in para 10.2 and pleadings made in the writ petition. 5. Learned State counsel, on the other hand, has submitted that the grievance of the petitioner can be very well redressed before the Court below by filing an application under Section 156 (3) or under Section 200 of the Cr.P.C. (now, under Section 175(3) or under Section 223 of Bharatiya Nagarik Suraksha Sanhita, 2023). 6. He further submits that the controversy involved in the present matter has already been decided by the High Court of Allahabad in Misc. Bench No. 24492 of 2020: Waseem Haider Vs. State of U.P. Through Principal Secretary, Home Others vide judgment and order dated 14.12.2020 as well as by this Court in WPCR No.333 of 2020 (Akhilesh Agrawal v. State of Chhattisgarh & Others) decided on 12.04.2023, dismissing the said petition, hence, the present petition be also dismissed in terms of the said order. 3 7. Accordingly, the present writ petition is dismissed with liberty to the petitioner to avail the appropriate remedy before appropriate Forum.
