1. Affidavit-of-service filed on behalf of the petitioners is taken on record. 2. By presenting this writ petition petitioners have prayed for direction upon the concerned police authorities for taking necessary steps based on the complaint lodged by the petitioners. 3. At the same time, order dated 25th March, 2025 passed by the Presiding Officer, Maintenance Tribunal, Kolkata under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 is questioned. 4. However, during course of hearing, it is submitted on behalf of the petitioners that leave may be granted to the petitioners to approach the appropriate forum challenging the order of the Presiding Officer, Maintenance Tribunal, Kolkata dated 25th March, 2025. 5. State respondents and respondent nos.7 & 8 are represented by learned advocates. 6. On behalf of the State respondents a communication dated 10th April, 2026 of Officer-in-Charge, Manicktala Police Station, Kolkata is filed and same is taken on record. Copies of the said communication dated 10th April, 2026 are made over to the learned advocates representing the petitioners and the private respondents. 7. It is disclosed in the said communication dated 10th April, 2026 that based on the complaint lodged by the petitioners a criminal prosecution was initiated being Manicktala P.S. Case No.16 dated 2nd March, 2025 under certain provisions of Bharatiya Nyaya Sanhita, 2023 and on concluding investigation charge-sheet being no.184 dated 25th December, 2025 was filed before the jurisdictional Magistrate. 8. In view of filing of charge-sheet, petitioners shall be at liberty to approach the jurisdictional Magistrate, if occasion so arises in future. 9. Writ petition stands disposed of. 10. However, this order shall not preclude the petitioners to approach the appropriate forum questioning order dated 25th March, 2025 passed by the Presiding Officer, Maintenance Tribunal, Kolkata under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.
