1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.58/2026 registered at Police Station Diggi, District Tonk for offences under Sections 189(2), 121(1), 132 and 303(2) of BNS, 2023 and Section 4/21 of Mines and Minerals (Development and Regulation) Act.
2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. It is further submitted that no specific overt act has been attributed to the present petitioners. The allegations levelled against them are general and omnibus in nature. The case of the present petitioners stands on the same footing as that of the co-accused persons. The main accused, namely Prahlad, has already been enlarged on bail by this Hon’ble Court vide order dated 25.05.2026. The present petitioners have been in judicial custody since 02.06.2026. Though one criminal antecedent has been reported against petitioner Ramavtar but he has already been granted bail in the said case. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, consequently, the bail application deserves to be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in light of submissions made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Ramavtar S/o Shri Madan, Kishan @ Krishan S/o Shri Ramswaroop and Kajod S/o Shri Ramlal, be released on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to
