01. The petitioner-Union Territory of J&K through Police Station, Shopian, through the medium of this petition seeks cancellation of interim bail order dated 28.11.2024 read with order dated 05.05.2025 passed in favour of the respondents-accused, by the Court of learned Principal Sessions Judge, Shopian, in case titled “Union Territory of J&K through P/S Shopian vs. Abdul Rashid Lone”, arising out of FIR No. 23/2014 of Police Station Shopian, for the commission of offence punishable under Sections 8/21 of NDPS Act. 02. The learned counsel for the petitioner submits that the respondent was initially admitted to interim bail on medical grounds on 28.11.2024, which has been extended from time to time. It is contended that despite the gravity of the charges involving the recovery of a
commercial quantity of 702 grams of Heroin, statutory rigors of Section 37 of NDPS Act, the accused was admitted to interim bail. 03. It is further submitted by the learned counsel for the petitioner that the case was listed yesterday before the Court below, wherein impugned interim bail order has been further extended upto 25.06.2026. It appears that the Court below granted and extended the interim bail based on “Renal Disease” as projected by the accused. The petitioner argues that the Court below has been extending bail in a routine manner since the year 2024, without deciding the application for its final disposal. 04. In the interest of justice, it is imperative that the bail application be considered for final disposal by the Court below after hearing the petitioner herein. 05. Viewed thus, this petition is, accordingly, disposed of with liberty to the petitioner to contest the matter before the Court below. The Court below is requested to decide the application for grant of bail finally, without resorting to extensions of interim bail, in a routine manner. 06. This petition, along with connected CM(s) stands disposed of as above.
