1. Affidavit of service filed on behalf of the petitioner is taken on record.
2. Matter is heard in presence of learned Advocates representing the petitioner and the respondents.
3. Petitioner was appointed in 2014 as Nutritionist for Nutrition Rehabilitation Centre (NRC) and is still working as Nutritionist in Bankura. Petitioner made an application in prescribed proforma on 12th December, 2022 seeking transfer in terms of the transfer scheme which was in vogue at the material point of time. It is submitted that till date such transfer application is not considered.
4. Petitioner prays for direction upon the concerned respondent Authority for consideration of his transfer application.

Mr. Bibek Jyoti Basu, learned Advocate representing the State respondents, has opposed this writ petition and it is submitted that transfer application was made far back on 12th December, 2022 and thereafter new scheme relating to transfer has been promulgated. Therefore, petitioner is required to make further application seeking transfer under the present scheme. Point of delay is also agitated before this Court.

Having considered the respective submissions made on behalf of the parties writ petition stands disposed of by directing the Executive Director, West Bengal State Health and Family Welfare Samity being the respondent no.2 to decide the transfer application of the petitioner dated 12th December, 2022 by eight weeks from the date of communication of this order. Decision to be taken by the respondent no.2 shall be communicated to the petitioner by fortnight thereafter.
7. It is made clear that all points are kept open. Since no affidavits are called for, allegations contained in the writ petition shall be deemed not to have been admitted by the respondents.
8. Urgent photostat certified copy of this order, if applied for, be made available to the parties upon usual undertakings.
