ORAL ORDER (PER: HON'BLE MR. JUSTICE VIJAYKUMAR A. PATIL)
This contempt petition is filed alleging willful disobedience of the order of the learned Single Judge dated 15.03.2023, passed in W.P. No.49448/2019.
2. The operative portion of the order reads as under;
"In the above circumstances, this Writ Petition succeeds in part; the impugned Resolution of the BDA whereby cancellation of allotment of sites has been effected, is set at naught by issuing a Writ of Certiorari.
The matter is remitted for consideration afresh with the participation of petitioners and after supplying a copy of the police report to them. All contentions are kept open. The remand to be accomplished within a period of three months.
The petitioners are restrained from alienating, encumbering or otherwise putting

up any structures on the subject sites till the enquiry is accomplished.
Costs made easy."
3. The respondent/accused filed an affidavit and the memo enclosing copy of the orders passed by the Authority pursuant to the direction of the learned Single Judge. The affidavit indicates that the Authority has issued notice to the writ petitioners and thereafter, passed appropriate orders. The memo dated 29.10.2025 filed by the accused also indicates that notice dated 23.02.2024 sent to the complainant is enclosed with copy of police report. Further, the reply submitted by the complainant to the said notice at page No.5 also makes reference with regard to the police report.
4. Hence, we are of the considered view that the direction of the learned Single Judge has been complied and there is no willful disobedience of the order of the learned Single Judge.

5. Accordingly, the contempt proceedings are closed. Notice issued to the accused shall stand discharged. It is open for the complainant to challenge the said order in accordance with law.
