JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.2 under Section 483 of the BNSS praying to grant bail in S.C.No.99/2020 arising out of Crime No.46/2018 of Barke Police Station pending on the file of III Additional District and Sessions Judge, Dakshina Kannada registered for offences punishable under Sections 120B, 36, 323, 395, 397, 201 and 149 of IPC. 2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent - State. 3. The petitioner earlier has been granted bail by order dated 21.09.2019 passed in Criminal Miscellaneous No.1392/2019. Thereafter, the petitioner appeared in the said case for some time. The petitioner remained absent on - 3 - HC-KAR NC: 2026:KHC:10348 CRL.P No. 13481 of 2025 11.03.2022. The NBW has been issued against him. The petitioner has been secured on 13.08.2025 by issuing NBW against him. Since then he is in judicial custody. The petitioner has now deposited Rs.25,000/- on 17.02.2026 and Rs.25,000/- on 18.02.2026 in S.C.No.99/2020. The said amount deposited by the petitioner has to be appropriated towards State towards forfeited bond amount. Now the petitioner has undertaken to appear before the trial Court on all dates of hearing. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. 4. In the result, the following ORDER i) The petition is allowed. ii) The petitioner is granted bail in S.C.No.99/2020 arising out of Crime No.46/2018 of Barke Police Station pending on the file of III Additional - 4 - HC-KAR NC: 2026:KHC:10348 CRL.P No. 13481 of 2025 District and Sessions Judge, Dakshina Kannada subject to following conditions: a) The petitioner –accused No.2 shall execute a personal bond for the sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the trial Court. b) The petitioner –accused No.2 shall not tamper the prosecution witnesses either directly or indirectly. c) The petitioner –accused No.2 shall attend the trial Court on all dates hearing unless exempted and co-operate for speedy disposal of the case. The amount deposited by the petitioner in sum of Rs.50,000/-(Rs.25,000/- + Rs.25,000/-) is to be appropriated to the State towards forfeited bond amount.
